David owned about 200 acres of land adjacent to the Conococheague Creek on the road between Cearfoss and Fairview His son, Daniel purchased his father's land from the estate in 1794 and his mother, Magdalena, signed away her dower rights. David owned about 200 acres of land adjacent to the Conococheague Creek on the road between Cearfoss and Fairview His son, Daniel purchased his father's land from the estate in 1794 and his mother, Magdalena, signed away her dower rights. Daniel died in 1833 in Welsh Run, Franklin County, PA, just 5 miles north of the Maryland farm he purchased from his father's estate. Daniel willed this Maryland farm (Franklin County, Pennsylvania Will Book D, page 270) to all of his children and recommended to his children the following: ".....Item 3 It is my Will that my executors rent my farm in Washington County, Maryland for money or on shares as they shall think best and the rent to be appropriated to paying my debts or if there be no debts, the rent shall be equally divided among my six children, their heirs or assigns until such time they agree on a majority of them to have it sold." The land is shown in Taggart's 1859 land ownership map of Washington County, MD. That parcel of land is listed as "Heirs of D. Miller". The land and farm remained under the ownership of Daniel Miller's children until his last living descendant, Nancy Miller, sold her "undivided" interest in the farm to George Shinham and his wife in 1873. Nancy and her brother, David, were co-owners of the farm. Nancy was single, but David had children. At that time, the land was physically divided into two parts with the Shinhams owning 1/2 and David Miller's children owning the other half. This division in ownership is shown in the 1877 map of Conococheague District 13 of Washington County, MD. During this ownership transfer, the property was advertized in a Hagerstown newspaper and the property description stated ".....and a small orchard of good fruit,....." This property is still under the ownership of George Shinham descendants in 2017. In discussions with them, they were unaware of any graves, marked or unmarked, which which were in the Orchard. The orchard no longer exists. David Miller Sr. was buried in his orchard, but it is unknown whether or not his wife, Magdalena, was also bried there when she died between 1794-1797.
