Description	:	This is the oldest Dover Cemetery of the multiple Dover Cemeteries in Belmont County. Old Dover Cemetery is located on Captina Creek in York Township in an area known locally as "fish basket". Originally, this cemetery contained approximately forty graves, some of which were unmarked and evidenced only by depressions in the soil. Old Dover Cemetery is located on Captina Creek in York Township in an area known locally as "fish basket". Originally, this cemetery contained approximately forty graves, some of which were unmarked and evidenced only by depressions in the soil. The cemetery was the subject of two law suits over several years. On May 10, 1978 the cemetery was excavated with large front end loaders by the Cravat Coal Company prior to strip mining the coal beneath it, setting off events that were reported nationwide by United Press International and one of the most famous civil lawsuits in the county history. The York Township Trustees, who had maintained the cemetery for decades, filed a lawsuit in Belmont County, Case Number 78 CIV 174. In the Trustee's case, Judge William Irwin ruled that the cemetery be searched for human remains by a professional, and then it could be mined, ruling against the Township and their claims under ORC 517.10, 517.22, etc. The Seventh District Court of Appeals upheld the ruling, and the Ohio Supreme Court refused to hear the case. In a separate lawsuit, 78 CIV 206, relatives sought to prevent further mining, restore the cemetery, and obtain punitive damages. Only juror Chester Perkins voted for the descendants. In 1986, after eight years of dispute, the coal company was allowed to strip mine the rest of the cemetery without a professional search for human remains prior to the mining. The cemetery was moved to it's present location along Captina Creek. Today, it's in sad shape, with many broken tombstones. This cemetery is identified as reference number # YO-07 (First Dover Cemetery / Dover Cemetery) on page 272 of “Your Guide to the Cemeteries of Belmont County, Ohio” published by Cumberland Trail Genealogical Society, January 2005.
