Upon Seth's death in 1860, ownership passed in succession to Seth's father Dr. William Hoyt, Dr. William's son Hiram, and Hiram's son Charles Edward Hoyt. In 1936 Charles and his wife Elizabeth recorded a deed in the Clearfield County courthouse stipulating the property "to be exclusively used for the purpose of a burial ground lot or cemetery for the heirs of Dr. William Hoyt."
