However, she died a few months later, never having collected any of the assets of the estate nor having made any disbursements. Herman W. Ellis was administrator for both Benjamin & Kate's estates. The benficiaries of their estate was the same in each case. The accounting for the estate was filed in Wayne County Superior Court 17 Jan. 1927. Note that other documents list John B. Shirley as being the guardian for Hazel. On 13 Feb. 1935, Hazel Ellis Shirley became 21 years of age & no long had need of guardianship, thus guardianship was discharged by order of the Court. J.O. Strickland had guardianship of Mildred Ellis. His guardianship was discharged 26 Mar. 1934. Goldsboro Savings & Trust Co. was the guardian for Raymond, Nina, Esther, Phoebe & Inez Ellis. GS&TC liquidated their account for the guardianship of those named on 17 April 1930. Apparently, as this was now the beginning of the Great Depression, Goldsboro S&T went under. The guardianship of the Ellis minors was transferred to Wayne National Bank by Jan. 1931. Attorney Kenneth C. Royall assisted in the transfer of funds. Also note that it does not appear that Benjamin & Kate had headstones but note that there are at least 2 sets of unknown gravesites w/ evidence of burials at Handley Family Cem. One of these is a double bricked tomb. The other is an area marked w/stones & one has a headstone which is illegible. Either of these could possible be where Ben & Kate were buried. Ben's parents & several siblings are buried in this cemetery.
