Description	:	CHARLES SMITH, aged about 58 years, committed suicide early yesterday morning, by hanging himself to a tree in the woods about a quarter of a mile from the home of Mr. Geo. Arnold, at Arnoldstown, about 4.5 miles southwest of Middletown. The body was found hanging in the tree about 4 o'clock in the afternoon, after a search for the missing man had been in progress since early morning. Mr. Smith had been confined to the Springfield Asylum, at Sykesville, for some time. On Wednesday Mr. Arnold went to the Asylum to see Mr. Smith and he begged Mr. Arnold so hard to let him return home for a few days that it was decided to allow him to do so. Thursday morning before breakfast Mr. Arnold went to Mr. Smith's room to awaken him and found him missing. Search was instituted in every direction, but no trace of the missing man could be found. Thursday afternoon Mr. Arnold started to Frederick to notify the authorities of Mr. Smith's disappearance and as he drove along he thought he saw a man in the woods some distance away. Thinking it might be Mr. Smith, he got out of the car to investigate. When he reached the place, he was horrified to find Smith's lifeless body hanging from a tree. Undertaker John Roelkey, of Burkittsville, was summoned and he sent for Justice of the Peace Kefauver, of Middletown. Upon reaching the scene and hearing all of the particulars, Justice Kefauver deemed an inquest unnecessary. Mr. Smith's wife died last January and ever since he had been suffering from melancholy. Some weeks ago it was found necessary to send the unfortunate man to the Asylum. He had no children. He was a member of the Church of the Brethren and was a son of the late David Smith. Smith, aged 69 years, of near Burkittsvile, who committed suicide by hanging himself to a tree in June last, was of unsound mind and not capable executing a valid deed or contract when he executed his alleged will, on Feb. 18, 1910, the case of B. Frank Sigler and others against John W. Young and Wm. W. Guyton, the executors of the estate, was taken up before a jury in the County Court Thursday of last week, with Judges Worthington and Peter on the bench. On Friday the case came to an abrupt end when the Court took the case from the jury. The decision meant in effect that the will as made by Smith will stand. The opening statement for the caveatees was made by Arthur D. Willard, attorney for the executors. He said Smith owned a small place and had a small amount of money. His wife inherited some money and he himself made some. Both were interest in charity work where they lived. Smith was assistant superintendent of the Sunday School of the Church of the Brethren and was an officer in the church. Mr. Willard said that in his will the testator left to the three relatives in California an amount of money he thought was proper. A year after the will was made Smith served on a petit jury in the County Court. Mr. Willard contended that Smith was very devoted to his wife, that after her death he brooded considerably and his mind then got in bad condition. The suit was brought by B.R. Sigler, Lizzie Null and Edna Bessett against John W. Young and Wm. A. Guyton, executors of the last will of Mr. Smith. The plaintiffs are nieces and a nephew of the deceased.
