THE BILYEA FAMILY: 1695-1953; BY LEILA BILYEA WILL OF HENRY BILYEA "This is the Last Will and Testament of me, Henry Bulyea, of the Township of London, in the County of Middlesex and Province of Canada, 'farmer'. "After payment of all my just debts, funeral & testamentary expenses, I give, devise and bequeath unto my eldest son James Albert Bulyea the sum of one shilling to be paid from the fifty acres of land hereinafter willed to my stepson whom I hereby adopt as my third son Robert Bulyea--to be paid one year after my demise. "And I give, devise and bequeath unto my eldest daughter Rachel Burns the sum of one shilling to be paid from the same source as James Albert's and at the same time. "Also to my second daughter Phoebe Ann paid the sum of one shilling to be paid from the same source as James Albert's & at the same time. "Also to my second son, Frederic Bulyea, the sum of one shilling to be paid from the same source as James Albert's & at the same time. "And also to my third daughter, Jemima McIntosh, the sum of one shilling & to be paid from the same source as James Albert's & at the same time. "And I will give, devise and bequeath unto my above named adopted son Robert Bulyea the north fifty acres of Lot number five in the fourteenth Concession of this township of which he is to have possession on the fifteenth day of May in the year eighteen hundred and fifty-seven, subject nevertheless to the five encumbrances mentioned above. "And I also give, devise and bequeath unto my youngest son, Nelson Bulyea, the west half of the southern three-fourths of Lot number five in the fourteenth concession of this township, of which he is to have possession when he is twenty-one years of age. All farm stock in live stock, implements, produce and with household articles to remain on the farm, subject nevertheless to the encumbrances hereinafter enumerated, that is to say that as it is my wish that my beloved wife Jane continue my widow--I will that she shall as such have the full management and control of the domestic affairs until my son Nelson be of age. After which it is my desire that my son Nelson take good and proper care of her, but should a separation take place then I will her the sum of ten pounds a year to be paid from my son Nelson's property. She still remaining my widow--but should she marry then my son Nelson's property shall pay her ten pounds, it being optional with him to pay the said ten pounds in money or in stock at a valuation. "I also will assign and bequeath to my three youngest daughters, namely Elizabeth, Miriam and Jane, a comfortable home with my widow or my son Nelson at his own place whilst single and when anyone of these get married that one is to get from Nelson at his option ten pounds in money or in live stock and bed bedding and furniture. "And it is lastly my will should anything of whatever account be left at my demise not mentioned in this will it shall be for the benefit of my son Nelson--as witness to my hand and seal this tenth day of January in the year of our Lord, one thousand eight hundred and fifty-two, at which time I have appointed Henery McIntosh and Frederic Bulyea the executors of this my last Will and Testament. "And it is further my will to state that the interlining between the fifth and sixth lines containing seven words bears out the true intention of this Will counting the lines from the bottom of the first page and that the word underlined in the fifteenth line from the top of the second page is correct, as witness my hand and seal on the day and in the year above written. "Signed and Acknowledged by the said Henery Bulyea the testator as and for his last will and testament in the presence of us who at his request in his presence and in the presence of each other, have hereunto subscribed our names as witnesses. Witnesses: WIlliam Taylor; Edward Granger; Henery Bulyea Submitted by Cathy Benedict. Henry was the first person to be interred in this cemetery.
