Sardinia, a native of Franklin Township, was born March 6, 1817. His parents, Benjamin and Sarah Hays, were natives of old Virginia. The former was born May 5, 1777, and latter October 2, 1782. They were married in Virginia and came to Brown County in 1811, and located in Franklin Township, where he was among the earliest pioneers. Mr. Hays died on the farm of his early settlement, January 8, 1868, and Mrs. Hays, September 28, 1860. Of their eleven children, seven are living. Our subject was reared to manhood on a farm. He married his first wife, Miss Martha Hannahs, who died April 23, 1844, and the 31st of July following, he married Mary. A. Purdum, who bore him nine children, of whom seven are living, viz.: Low M., Areton W., Joseph P., William F., James F., Charlie G. and Clara M. Mr Hays and wife are associated with the M. E. Church. In politics, he is a Republican. He owns a farm of 118 acres, and is engaged in farming and rearing stock. ------------------------------------- APPLICATION FOR PROBATE OF WILL. THE STATE OF OHIO. LAST WILL AND TESTAMENT of Henry Hays, Deceased. To the Hon. Eli B. Parker Judge of the Probate Court in and for said County: Your petitioner would respectfully represent the Henry Hays a resident of the Township of Washington in said County, died on or about the 10 day of September A.D. 1889, leaving an instrument in writing, hereto attached, purporting to be his last WILL AND TESTAMENT. That the said Henry Hays died leaving Mary Ann Hays widow and the following named persons his only next of kin: Lou Mirza Hays, daughter, Sardinia, O. A. W. Hays, son, Ulisses, Neb. Pilson Hays, son, Imperia, Neb. James Hays, son, Kansas City, Mo. Charley Hays, son, Sardinia, O. Clara Hays, daughter, Sardinia, O. W. F. Hays, son, Sardinia, O. Your petitioner prays that a time may be fixed for the proving of said Will, and that said above named persons may be notified according to law of the pending of said proceedings. Signed W. F. Hays. In the Name of the Benevolent Father of all, I Henry Hays of Brown County, Ohio, do make and publish this my last Will and Testament. I give and devise to my beloved Wife Mary A. Hays in lieu of her dower the farm on which we now reside containing about 103 acres of land together with all my personal property during her natural life, or so long as she shall remain my Widow, my Executor hereinafter named however selling so much of my personal property as may be sufficient to pay my just debts, and if my personal property shall be insufficient to pay said debts then in that case I hereby authorize and direct my said executor to sell and convey to purchaser a sufficient amount of my said real estate to pay the residue thereof. I devise my said Wife and children to furnish my Brother Martin Hays a home on the farm which we now reside for and during his natural life. If my said wife should marry or at her death then in either case the real estate aforesaid I give and devise to my children Loumirza, Areton W., J. Pilson, William F., James F., Charles G., and Clara Manessa, to be divided equally between them subject to the payment of three hundred dollars to my daughter Loumirza as provided for hereinafter. I do hereby nominate and appoint my Son William F. Hays Executor of this my last will and testament hereby authorizing and empowering him to compromise, adjust, release and discharge in such manner as he may deem proper the debts and claims due me. I do also authorize and empower and direct him at the marriage or death of my said Wife to sell all of my said real estate at public or private sale without appraisement upon such terms of credit or otherwise as he may think proper and Deeds to the purchasers to execute acknowledge and deliver in fee simple and I hereby direct him to divide and disburse the proceeds thereof as follows. First to pay my Daughter Loumirza Hays the sum of three hundred dollars mentioned in the first item of this will and which hereby give and devise to her. Second to pay the residue first four hundred dollars to my Daughter Loumirza Hays, second to pay my Daughter Clara Manessa Hays three hundred dollars, third I give and bequeath to my Son William F. Hays the following parcel of land described as follows, corner of William F. Hays in the line of Henry Hays thence North with said line to said Henry Hays corner in the line Widow Drapers corner in said line thence North with said line of Hay and Draper to John Purdum and Hays line to John Purdums corner in the line of Margaret Purdy thence South with said Margaret Purdy and Henry Hays to Margaret Purdy and S. E. Purcells corner thence South with said Purcell and Henry Hays to Purcells corner in said Hays line thence South to a Maple and Stone thence West to the beginning containing 20 acres of land more or less, fourth pay to my Son A. W. Hays one hundred dollars and my son J. P. Hays one hundred dollars and Jas. F. Hays the same amount and my son Charley G. Hays to have the residue. I do hereby revoke all former wills by me made. In testimony hereof I have hereunto set my hand and seal this 29 day of May A. D. 1888. Signed Henry Hays.
