Henry enlisted for a second time as a Private in Co. E, 40th Massachusetts Infantry and was mustered into service on August 31, 1862. He was subsequently promoted to Corporal in October 1862 and to Sergeant on October 1, 1863. During his service his regiment was assigned to the defenses at Washington from Sept. 1862. In the spring of 1863, as part of the 7th Corps and later the 4th Corps, they were on the Virginia peninsular, returning to Washington in July. A month later, in August, they moved to South Carolina where they were involved in siege operations on Folly and Morris Islands, including against Battery Wagner, famed for the assault by the 54th Massachusetts. In the winter of 1864 they were sent to Florida where they were engaged at the battle of Olustee. The regiment was shifted for the final time back to the Virginia theater in the late spring of 1864 where they fought at Drewry’s Bluff. In early June they were part of Grant’s ill-fated assaults against Confederate positions at Cold Harbor. Henry was wounded in the left leg on June 3, 1864 during heavy fighting at Cold Harbor, VA and was admitted to a nearby field hospital before he was evidently sent to Fortress Monroe in Hampton, VA where he other wounded were evacuated by hospital boat. The boat arrived at Washington on June 10th and the wounded were taken to Armory Square Hospital. Henry, however, was “dead when brought in.” He was buried on June 12th at the Military Asylum Cemetery in Washington, but two days later his remains were exhumed, embalmed and returned to home for interment at the Thomastown Cemetery in Middleboro.
