JAMES CUNNINGHAM, oldest son of Joseph & Agnus Cunningham Sr., was born in Buckingham Co.,VA in 1784. On October 6, 1808, he married Judith Sutherland in Bedford county; they were married by John Ayers. Judith, daughter of Philemon and Frances (Penick) Sutherland, was born June 10, 1792 in Franklin County and was one of nine children. Philemon Sutherland was one of the original settlers of Franklin County and a veteran of the Revolutionary War. He enlisted in Prince Edward County at the commencement of the Revolution, served as a private in Captain John Morton's Virginia Company and was in the battles of Trenton and Brandywine, serving two years. He again enlisted and was at the capture of Cornwallis. He died July 12, 1811 and left 483 acres to Judith and James. (James sold this property to his brother, Joseph, in 1830). Frances (Fanny)Sutherland died in the spring of 1848. James Cunningham served in the War of 1812 as a Sgt. in the Virginia Infantry Militia. He served at Ft. Norfolk from Sept. 8, 1813to March 10, 1814. He was a farmer in Franklin County and in the mid 1830'5, came to Missouri and settled in Saline County about three miles SE of what is now called Marshall Jct. (Intersection of I-70 and 65 Hwy.) Their home was on a small hillside that came to be known as Cunningham Hill and the family cemetery is nearby. James died Nov. 29, 1850 and Judith died July 21, 1858 and both are buried in the family cemetery. James lefi no will and his only son, Joseph Peter, was named administrator of his estate on Jan. 9, 1851. From the court records, there seems to have been some conflict among the children over James' estate. Commissioners were named to divide the property and a "certain suit" was to be dismissed by Joseph.‘ James left an estate of 11 slaves and over 700 acres of land.
