JAMES L. MUNCHRATH, 19
James Leo Munchrath, 19, son of Mr. and Mrs. Delbert Munchrath, Defiance, was born at Harlan, Iowa, Feb 14, 1947.
All his life, he lived at Defiance and attended St. Paul’s School from which he graduated in May 1965.
Jim was very active in sports. He lettered in basketball and baseball while attending high school. He also played baseball for the Defiance town team and bowled with a group of Defiance boys. He was a member of the National Guards at Council Bluffs.
Since graduation from school he was employed at Western Iowa Pork at Harlan.
April 3, he was injured in a car accident at Sioux City, Iowa. He laid in a critical condition in St. Joseph Hospital for six weeks. His death occurred on May 11, 1966 from a head injury and internal injuries.
He is survived by his parents, Delbert and Vera, of Defiance; brothers and sister, Roger, of Omaha. Sheryl, Bill, Mary Kay and Shelly, all of Defiance; his grandmother, Mrs. Barbara Munchrath of Defiance; uncles and aunts, Mrs. Ed Goeser, Leo Munchrath and Beatrice Munchrath, all of Defiance, Ivo Finken and Denny Finken of Earling, Mrs Elmer Schneider and Mrs Walter Schneider, Harlan, Tooty Finken of Omaha, Mrs. Art Ebert of Denver and Mrs Rita Finken of Sioux City.
A large crowd attended the Solemn Requiem High Mass at St. Peter’s church at 10 a m Saturday, May 14, Rev Father Deere acting as celebrant, Rev. Frank Reid, deacon and Rev Eugene Koch, sub deacon.
The pallbearers, all baseball players, were Warren Schaben, Vernie Miller, Paul Goeser, Don Dotzler, Jim Mulligan, and Dick Munchrath He was laid to rest at St. Peter’s cemetery at Defiance.

Youth Dies in Crash; 3 Others Hurt
Defiance Boy, 18, Killed; Another 'Critical' Here
An early morning traffic accident Sunday on Interstate 29, under the Riverside overpass near the South Dakota border, claimed the life of a Defiance, Iowa, teen-ager.
Three other youths were hospitalized, one of whom was reported in "critical" condition Monday.
Samuel Gross, 18, apparently died instantly when he was thrown out of the car and his head struck a concrete pillar. Dr. Thomas L. Coriden, Wood bury County medical examiner, said the youth also suffered massive chest wounds.

James L. Munchrath, 19, Defiance, was reported in "critical" condition at St. Joseph Mercy Hospital with head injuries. In "satisfactory" condition at the hospital Monday were Larry L. Kimmen, 17, Earling, Iowa, and James C. Goetz, 18, Defiance, the driver. They were taken there by Sioux Ambulance Service.
Defiance and Earling are in Shelby County.
The Goetz car was traveling east into Sioux City on the Interstate, after the four had been in North Sioux City, according to Sioux City police and the Iowa Highway Patrol.
The driver evidently lost control of the car, and it went into a ditch, hit a guardrail, struck a pillar of the overpass and slammed into the bridge itself. All four youths were thrown out of the 1966 model automobile, which had 4,115 miles on the odometer. The car was a total loss.
Police said there apparently was a high rate of speed involved.
Patrolman Dick Lindgren .of the Traffic Bureau reported Monday that investigation of the accident is continuing.
The accident occurred just after midnight, and the Gross youth was pronounced dead on arrival at a hospital about 12:45 a.m. Sunday.
The death of young Gross was Sioux City's second traffic fatality of the year. Sarah Hanson, 17, 513 W. Fifth St., died Jan. 27 of injuries she suffered five days earlier in a one-car accident in Leeds.
Gross Funeral Set
Funeral services for Samuel Gross will be at 10 a.m. Tuesday at St. Peter's Catholic Church at Defiance. The Rev Gerald Deere will officiate. Burial will be in the church cemetery.
Young Gross was born March 27, 1948, at Manilla, Iowa. He was a senior at St. Paul's High School at Defiance and was prominent in the school's athletic program.
Survivors include the parents, Mr. and Mrs. Norbert Gross of Defiance; three brothers and four sisters.
The body was sent from the Manning - O'Toole Funeral Home to the Pauley Funeral Home at Harlan, Iowa.

Youth Hurt in Auto Crash Here Is Dead
An early morning, one-car accident Sunday, April 3, in Interstate 29 at the Riverside interchange has claimed the life of a second Defiance, Iowa teen-ager.
James L. Munchrath, 19, died Wednesday night at a Sioux City hospital. He suffered head injuries in the accident.
Samuel Gross, 18, Defiance was killed instantly in the accident.
The death was Sioux City's fifth traffic fatality of 1966 compared with three to this date in 1965.
James C. Goetz, 18, Defiance, was driver of the car and Larry L. Kimmen, 17, Earling, Iowa, also was a passenger.
Funeral services for Mr. Munchrath will be at 10 a.m. Saturday at St. Peter's Catholic Church at Defiance. Burial will be in the church cemetery under the direction of the Pauley Funeral Home of Harlan, Iowa.
Mr. Munchrath was born Feb. 14, 1947, at Harlan. He was a graduate of St. Peter's High School and was employed by a Harlan meat packing firm.
Survivors include the parents, Mr. and Mrs. Delbert Munchrath of Defiance; two brothers, Roger of Omaha, and William, at home; three sisters, Sheryl, Mary Kay and Shelly, all at home; and the paternal grandmother, Mrs. Barbara Munchrath of Defiance.

Dies of Injuries At Sioux City
SIOUX CITY, IA. (AP) - A one-car accident on interstate 29 in Sioux City Apr. 3 has claimed the second life.
James L. Munchrath, 19. Defiance, died of injuries in a Sioux City hospital Wednesday night. Another Defiance youth. Samuel Gross, 18, was killed instantly when the car went out of control at the Riverside interchange with 1-29. Two other youths were injured in the crash.

Arraign 14 Indicted by Grand Jury
Fourteen persons were scheduled for arraignment Wednesday afternoon in District Court before Judge C. F. Stilwill.
They were indicted earlier this week by the Grand Jury lor the September term
They are: Steven Oliver, failure to give aid to an injured party; Obie Dean, carrying a concealed weapon; Iris Garcia, uttering a forged instrument; James Fuehrer, conspiracy to commit a felony; Roman P. Thoma, breaking and entering; Larry Hudson, failure to support; Michael Vander Schaaf, conspiracy to commit a felony; Dave Simons, conspiracy to commit a felony; Ronald G. Halbert, embezzlement by bailee; Jim Rogers, false drawing and uttering of a check; Andrew J. Wright, larceny of a motor vehicle; Cecil Foote, larceny; James C. Goetz, manslaughter; and Richard L. Kleinberg, larceny.
Oliver, who already had been Indicted for manslaughter, was to enter a plea on a second charge of failure to give aid to an injured party. He was identified as the driver of a car which struck Natasha Bodine, 13-year-old daughter of City Manager and Mrs. Conny Bodine, 4115 Country Club Blvd., while the girl was returning home from school April 19. She died the next day.
Oliver was apprehended later that day.
Goetz, who is charged with manslaughter, allegedly was driver of a car April 3 in which two Defiance, Iowa youths were killed. The victims were Samuel Gross, who was killed instantly in the one-car accident on Interstate 29 at the Riverside Interchange, and James L. Munchrath, who died May 12. Both were passengers in the car.

Arraign 14 Here; 1 Pleads
Stephen Oliver, indicted by a Woodbury County Grand Jury earlier this week on a charge of failure to give aid to an injured party, pleaded, innocent when he appeared for arraignment Wednesday afternoon in District Court.
Oliver was one of 14 persons indicted by the Grand Jury who appeared for arraignment. Previously indicted for manslaughter, Oliver has been identified as driver of the car which struck Natasha Bodine, 13, on April 19. Miss Bodine died the following day. Oliver reserved the right to file a motion in the case on a later date.
Others appearing in District Court before Judge C. F. Stilwill, also waived formal arraignment.
They were:
Obie Dean, charged with carrying a concealed weapon, was given until 10 a.m. Sept. 21 to move or plead.
Iris Garcia, charged with uttering a forged instrument, was given until 10 a.m. Sept. 21 to move or plead.
James Fuehrer, charged with conspiracy to commit a felony, was given until 10 a.m. Sept, 21 to move or plead.
Roman P. Thoma, charged with breaking and entering was given until 10 a.m. to move or plead.
Larry Hudson, charged with failure to support, did not appear and his arraignment was continued to 10 a.m. Friday.
Michael Vander Schaaf, charged with conspiracy to commit a felony, was given until Sept. 21 to move or plead
Dave Simons, charged with conspiracy to commit a felony, and was given until 10 a.m. Sept. 21 to move or plead.
Ronald G. Halbert, charged with embezzlement by bailee, was given until 10 a.m. Sept. 21 to move or plead.
James Rogers, charged with false drawing and uttering of a check, did not appear and his arraignment was continued to 10 a.m. Friday.
Andrew J. Wright, charged with larceny of a motor vehicle, was given until 10 a.m. Sept. 21 to move or plead.
Cecil Foote, charged with larceny, and was given until 10 a.m. Sept. 28 to move or plead.
Richard L. Kleinberg, charged with larceny, and was given until 10 a.m. Sept. 28 to move or plead.

Judge Studies Manslaughter Charge Protest
Judge C. F. Stiliwiil has taken under advisement information presented Friday in a hearing in District Court regarding admissibility of a written statement made April 4 by James Goetz of Defiance, Iowa, who is charged with manslaughter. Goetz claims now he wasn't advised of his constitutional rights.
Goetz, 19, allegedly was driver of a car April 3 in. which two Defiance youths were killed.
The victims were Samuel Gross, who was killed instantly in the one-car accident on Interstate 29 at the Riverside Interchange, and James L. Munch- rath, who died May 12. Both were passengers in the car.
Goetz, who was indicted on the manslaughter charge by the September term of the grand jury, signed the statement in question while a patient at St. Joseph Mercy Hospital, the day following the accident.
He is free on $10,000 bond

Rule Statement in Manslaughter Case Admissible
A motion to suppress a written statement April 4 by James Goetz of Defiance, Iowa, who is charged with manslaughter in District Court, has been overruled by Judge C. F. Stilwill following a week's deliberation.
Attorneys for Goetz, 19, had moved to suppress the written statement alleged to have been signed by him April 4 while he was a patient in St. Joseph Mercy Hospital.
Goetz suffered injuries as the result of a one-car accident April 3 in which two Defiance youths were killed.
The statement in question was taken by Dale P. Asmann, police traffic investigator.
In the ruling, the court contends that Goetz was not placed under arrest and was not in custody while giving his statement and that he was coherent. It concludes that the statement was voluntary and all evidence surrounding taking of the state ment will be submitted to jury upon trial and it will be up to the jury to determine the weight to be given the statement and the circumstances.
Goetz, alleged driver of the car, is free on $10,000 bond. He was indicted on the manslaughter charge by the September term of the grand jury.

Begin Selection of Jury to Hear Manslaughter Case
The process of selecting a jury began Thursday morning in the manslaughter trial of James C. Goetz, 19, of Defiance, Iowa, in the District Court of Judge George M. Paradise.
Goetz was charged with manslaughter after a traffic accident April 3, 1966, claimed the lives of two other Defiance youths, Samuel N. Gross, 18, and James L. Munchrath, 19.
The early-morning accident occurred under the Riverside overpass of Interstate 29 near the South Dakota border. Goetz and another youth, Larry L. Kimmen, 17, of Earling, Iowa, also were injured.
All four youths were thrown from the car.
Goetz is free on a $5,000 bond.

Enters Plea in 2 Deaths
James C. Goetz, 19, Defiance, Iowa, pleaded guilty Friday afternoon to a lesser charge of assault with intent to commit a felony, to wit: manslaughter, as he appeared before Judge George M. Paradise in District Court.
The jury had been picked earlier in the day and Goetz's trial on a charge of manslaughter was set for Monday.
He had earlier pleaded innocent to the manslaughter charge, stemming from a traffic accident April 3, 1966, which claimed the lives of two other Defiance, Iowa, youths, Samuel N. Gross, 18, and James L. Munchrath 19.
Goetz, alleged driver of the car, was 18 at the time of the accident which occurred under the Riverside overpass of Interstate 29. He and another youth, Larry L. Kimmen, 17, Earling, Iowa, were injured.
Sentencing for Goetz, who is free on $5,000 bond, was set for 1 p. m. Feb. 24. A pre-sentence investigation was ordered.

Suspended 5-Year Term lo Youth
James C. Goetz, 19, Defiance, Iowa, who pleaded guilty to assault with intent to commit manslaughter in the traffic death of two other youths, was sentenced in District Court thi3 afternoon to the Men's Reformatory at Anamosa for a period net to exceed five years.
The sentence then was suspended by District Judge George M. Paradise.
Judge Paradise suspended the sentence on the express condition that the youth "shall not operate a motor vehicle on public streets, highways or roads in Iowa for a period of two years from this date", and also during good behavior. Goetz was put on probation to the state board of parole. |
