(Smith) Stanley & wife Frances, Chafin Key & wife Nancy, John White & wife Elizabeth, William White & wife Mary vs Thomas White, Bob White, Sanders White, Henry White, Martin Smith & wife Alice The plantiffs complaint and alleges I. That on the 27 day of April A. White Sr being the owner in fee and possession of the following tract of land lying and being in County of Surry and State of North Carolina adjoining the lands of P. C. Lane, Elizabeth Gillespie & T. F. Anthony containing 62 acres the same was sold by Samuel H. Taylor the then sheriff of Surry County and at the request of A. White and interest for the the benefit of said A. White and R. S. White became the purchasers of said tract of land at the price of $30.00 a deed was made to him by the said S. H. Taylor sheriff as aforesaid. II. That subsequent thereto and prior to the death of said A. White the said A. White pursuant to said agreement as above set forth paid back to said R. S. White nearly if not all of said purchase money. III. That on the (blank) day of (blank) 1888 the said A. White died being then and there the possession of and using said land as his own living at the time of death the plantiffs and defendants his children and heirs at law. IV. That upon the death of the said A. White the said R. S. White took possession of said land claiming the same under and by virtue of said deed and refuses to convey the same to said heirs of A. White as plantiffs are informed and believe it was his duty to do and refused to let plantiffs into possession of said lands to bring into possession of the same at the commencement of this action. V. That plantiffs are ready & willing to pay said R. S. White any amount of the balance of the said purchase money that may be found due if any shall be found due. Relief Wherefore plantiffs demand that the said R. S. White to declare a trustee for the plantiffs and defendants to this action and the said land be sold under an order of this court and the money arising from the said sale be divided among the said parties to this action equally or in the event the court should be of the opinion that plantiffs are not entitled to said sale that then he be required to convey said land to the said parties as above set forth and for such other and further relief as plantiffs may be entitled and as this Court may deem just. (Smith) Stanley & wife Frances, Chaffin Key & wife Nancy, John White & wife Elizabeth, William White and wife Nancy vs. Thomas White, Bob White, Sanders White, Henry White, Martin Smith & wife Alice, children of A. White, deceased. Defendants answering say: 1. That allegation No. I of plantiffs complaint is true, in so far as alleledges that a tract of land was sold by S. H. Taylor the then sheriff of Surry County and that defendant Sanders White became the purchaser for the sum of $30.00, but that he bought at the request of the said A. White, who was his father, on an agreement with the said A. White that he should allow him to remain on the land and use it as his own until his death, and which said agreement the said defendant Sanders White has in all things complied with. 2. That allegation No. II of the complaint is untrue, but defendant S. White admits that he owed A. White at his death a small amount of borrowed money, but not on account as set forth in complaint and answers his willingness to repay the same whenever there shall be an adminstration appointed or other person authorrized to receive it. 3. That allegation No. 3 of the Complaint is true. 4. That allegation No. IV of Complaint is untrue in so far as it alleges that the defendant R. S. White took actual possession of said land after the death of A. White, but admits that a short time after his death and before the commencement of this action he sold the lands to defendants Henry White & Martin Smith on the verbal condition that the said Henry White and Martin Smith should take care of A. White's widow the mother of defendant Sanders White, during her lifetime and which said agreement has been fully complied with on the part of said Henry White and Martin Smith. And futher answers to said paragraph says that there has never been any demand made upon him at any time by the other heirs of said A. White for a conveyance of the said land. 5. That as to allegation No, 5 he does not know and has not sufficient in formation upon which to found a belief, no offer or tender of any amount , ever having been made to him at any time by any of the parties in interest. Wherefore defendants ask judgement that the action be dismissed and that they recover judgement further costs of the action, to be taxed by the clerk. J. H. Dobson, Attorney for Defendants 961

1897 August 26 - Surry County, North Carolina - Will of John Edmond Stanley: I J. (John) E. (Edmund) Stanley of the County of Surry State of North Carolina do make and publish this my last will and testament. I first will and bequeath unto MY SON THOMAS Stanley a certain portion of my land and all of that part lying on the north side of the Ridge road leaving from J. M. STANLYS house to the mill road on top of the Ridge between the Fords of two branches East of S. W. Roberts house and in consideration MY SON THOMAS is to come and live with me and my wife and take care of us, feed, clothe and pay all Doctor bills that may occur for us and see us properly cared for in every respect as long as we both may live and in case OUR SON THOMAS should die before either of us or in any way fail to take care of us; then in such case I reserve unto ourselves the right to rent, sell or in any way dispose of said land or so much thereof as may be necessary for our maintenance as long as me and my wife shall live and after me and my wife decease, the remainder of the above described land, if any left unsold, to go to our son, THOMAS'S HEIRS after our decease, the remainder of our land on the south of the said road and our personal property to be sold to the highest bidder for cash and all debts to be collected and money on hand if any, and all money to be equally divided between my several children after our bureal expenses is paid out of the same. And I do hereby make and ordain MY SON SOLOMON STANLY executor of this my last will and testament in Witness whereof I, J. E. Stanley have hereunto set my hand and seal this 26th day of August 1897. Stanley late of said County is dead having made and published his last will and testament which is exhibited before me for probate by SOLOMON STANLY the executor therein named and it appearing upon the oath and examination of A. PHILLIPS & M. B. STANLY the subscribing witnesses thereto that the said J. E. Stanley at the time of signing said will was of lawful age to execute a will, was of sound mind memory and not under any restraint to the information and belief of said witnesses thereto. It is therefore ordered and adjudged that the said paper writing and every part thereof is the last will and testament of the said J. E. Stanley the same is ordered to be recorded and filed and that SOLOMON STANLY the executor therein named be allowed to qualify he having taken the oath prescribed by law for executors. John Edmond married Martha J. "Patsy" WHITE, daughter of Albert WHITE Sr. (ca 1800-April 1884) & Margaret MOORE (ca 1802-9 November 1845). Born on 6 January 1824 in Surry County, North Carolina. Martha J. "Patsy" died in Surry County, North Carolina on 28 December 1907, she was 83. Buried in Stanley Family Cemetery, now Open Door Baptist Church Cemetery.
Paternal grandparents were Jesse Stanley, Sr. and Mary Smith Stanley. Maternal grandparents were Edmund and Sarah Walker Pace.
