An after-dark rabbit hunt by three boys in a station wagon ended in death for Joseph Short, 17, near Madrid Thursday evening. Short, who lived on a farm north of Madrid, died in an ambulance on the way to Mercy Hospital in Des Moines after being struck in the back of the head by a .22-caliber bullet. The other two boys, Jack Titus, 18, of Madrid, and Alllen Lance, 17, of Huxley, told Madrid Police Chief William J. Allen the three were hunting from an automobile on a county road one and one-half miles southwest of Madrid. Rabbit: About 10:15 p.m. they spotted a rabbit bounding across the road. Titus and Lance jumped out immediately, Lance carrying a .22-caliber automatic rifle, the only gun the youths had with them. Lance shout to Short to "bring the flashlight." "He Fell": Short stepped out of the car, fell, stood up and "in some way walked into the line of fire just as Lance fired." Allen said. lance and Titus put Short in the car and drove to Dr. Don Gillman's home in Madrid, where they were told the doctor was at a bowling alley. Found Doctor: Lance and Titus tried to locate another doctor but failed and then went to the bowling alley and found Dr. Gillman. Police Chief Allen said Dr. Gillman, after examining the wound, ordered Short taken to a Des Moines hospital. The Sundberg Funeral Home ambulance left Madrid with Short "about 11 p.m.," Allen said. "Rumor": Mercy Hospital reported Short was dead when the ambulance arrived there at 11:55 p.m. There was some discussion in the bowling alley that Short had fallen on the ice while hunting. "That was just rumor going around the bowling alley. Titus and Lance didn't say that. They told me what happened," the police chief said. Laws: Allen said he referred the case to Warren Wilson, state conservation officer for Boone County, "because violation of two laws involved." Wilson said state law makes it a misdemeanor to hunt rabbits at night. The penalty is a fine of $10-$100. Wilson said also is a misdemeanor to carry a loaded gun in an automobile. Investigation of the fatal shooting of a Madrid youth, Joseph Short, 17, continued today, but no charges have been filed against his two hunting companions. Short Jack Titus, 17, Madrid and Allen Lantz, 17, Huxley, were allegedly hunting rabbits Thursday night in violation of state law when the shooting occurred. Rifle Wound: Short was dead on arrival at Mercy Hospital, Des Moines, from a .22 rifle wound in the head behind one ear. Titus Friday had signed a statement saying Lantz had fired the fatal shot. The youths were hunting about one mile east and one half mile south of Madrid when the shooting occurred. Madrid, Iowa Marshall William (Bill) Allen, Jr., said the boys were using flashlights to hunt rabbits in violation of state hunting laws. Lantz told Boone and Story County law enforcement officials Friday that Short was holding the flashlight while he fired the gun. Short fell after the gun was fired, and Lantz and Titus thought he had slipped on the ice and hit his head. Lantz told officials they took Short to Madrid to see a doctor, found one at a bowling alley and that the doctor told them he had been shot. Ruled Accidental: An ambulance was called, but Short died en route to Des Moines,. The shooting was ruled accidental by the Polk County coroner. Warren Wilson, Boone, State Conservation Officer for this area was not available today to comment whether he intended to file charges for the alleged state hunting law violation.
