He had a brother, John Muller, who taught seven languages and was a band leader in a all boys college in Ireland - Rockwell College (and he was a Priest). In South Dakota, Joseph married (1st) Emma Catherine Reynolds. They divorced in June of 1891 and Emma changed her last name to Miller. She moved up to Port Huron, Michigan, went toMedical School and became a Physician. Mueller & Joseph Mueller - Dated June 13, 1891 In Circuit Court, Sixth Judicial Circuit Emma K. Mueller - Plaintiff vs Joseph Mueller - Defendent Decree This action having been brought to be heard on the 13th day of June 1891. Upon the complaint of the plaintiff above named and to be served upon the defendent herein and that more than thirty days have elapsed since the date of such service, and no appearance having been made by the defendant herein, and the testimony of Emma K. Mueller, Plaintiff and G. Florence and Cora Connor, witnesses having been given before me and then appearing from said testimony to the complaint are sustained by the testimony, free from all legal exceptions as to its competency, admissibility and sufficiency, and that such matters as alleged and proven on behalf of the plaintiff, are sufficient in law to entitle the plaintiff to the relief prayed for in the complaint; that the plaintiff has been in good faith, a resident of the State of South Dakota for more than 90 days, preceding the commencement of this action. Now therefore on Motion of J. H. Bottom, councel for Plaintiff it is Ordered, Adjudged and Decreed, that the court by virtue of the authority therein vested and pursuance of the Statutes in such cases made and provided does Order, Adjudge and Decree, that the Marriage relations existing between the said plaintiff emma K. Mueller and the said defendant Joseph Mueller, be dissolved and the same is hereby dissolved accordingly and the said parties are, and each of them is freed and absolutely released from the bonds of matromony and all the obligations thereof. And it is further ordered and decreed that the plaintiff the said Emma K. Mueller have the sole custody of their child Laura M. Mueller, the issue of the said marriage. Native born citizen? - I am not, I was born in Germany Acres broken - 5 1/2 acres first year, 5 1/4 acres the second year, did not break more more out the third year Acres cultivated - 5 1/2 acres was cultivated the second year and planted to Box Elder Tree seeds. Third year cultivated 5 1/4 acres and replanted the first 5 1/2 acres to Ash Tree seeds. Acres planted - replanted the 5 1/2 acres planted the second year to Ash Tree seeds. I know the number of acres because I measured it. Acres 4th year - The fourth year, I replanted the first 5 1/2 acres again and planted 5 1/2 acres more to Box Elder seeds. Received an extension? - I ask for an extension once but did not hear from it. On account of destruction? - None by grasshoppers. I had trees killed by drouth in 1887, 1888, 1889, 1890 and 1891. The trees would come up nice and die in the fall and winter. Acres of Timber kept healthy for 8 yrs - Planted 10 1/4 acres - protected it and cultivated it but could not keep the trees growing on account of drouths. Describe the trees growing - I cannot determine the number, the trees are comming up nice from last years planting but are very small. Their condition so far is healthy. I know this by examining the land and the trees. I replanted the first 5 1/2 acres in 1887; replanted it again in 1888 and planted 5 1/4 acres more, cultivated the trees in 1889, replanted the whole 10 2/4 acres in 1890, 1891, and 1892. It was possible to "establish" births by proofs and affidavit, but apparently, none of the Evanses did. Marriage records were recorded in the County of occurrence back in the early 1880's but there is not record of Sarah and Joseph Mueller's marriage in Hand County. ______________________________________________________________ Memories from a Granddaughter in 2001: I was very surprised to hear about Grandpa's tree planting etc (the Timber Culture Land Patent). Of course, I never did hear much about him - he was gone before Grandma. I was 6 shen she died and barely remember her. In fact,my memories are of the water faucet dripping into a pail next to the room where she and I slept and then seeing her in her coffin at her house. In those days, they kept the body there until the funeral service. People came by to pay their respects. The leaking faucet was memorable because we had no faucet at our house - water was carried from the well. It was 'running water' if we ran with it! And I can't understand how people got so far in those days with the transporation they had. The land on which he planted trees on the Hand County map is south of Miller - which is 30 miles from Orient. Also, mom (Josephine Mueller Eaton) was born at Eureka and that is about 75 minutes northeast of here. And it seems they said he ran an Elevator at Eureka and I thought - in fact, I'm sure - that he ran the Elevator at Orient at one time. One of my husband's relatives said they used to visit him when they went to Orient. That must have been a hard job for him as he had Asthma (that's where I got it) and 5 minutes in an elevator would 'do me in' with all the grain dust. Provided by Gone to Soon - June 21, 2014
