The father, Lilburn Hale, was a farmer by occupation, and one of the substantial, highly respected citizens of the county. He lost his life during the war, being accidently shot by bushwhackers, April 2, 1862. He was on his way home from Shelbina, and had fallen into the company of a body of Federal soldiers, traveling the same road. He was riding by the side of Col. Lipscomb, the commander of the soldiers, when unexpectedly they were fired upon by bushwhackers, who were lying in ambush for the soldiers, which resulted in Mr. Hale's father and two of the soldiers being instantly killed, and three other soldiers being wounded, one of whom died soon afterwards. Although a Union man in principle, he had taken no part in the war, and his death, therefore, was purely accidental. His widow is still living on the farm south of Shelbyville, where the family had settled previous to her husband's death. She is now in the seventy-first year of her age. Her youngest son, Lilburn S., has charge of the place. James C. Hale was born in Sullivan county, in Eastern Tennessee, August 7, 1838, and was therefore seven years of age when his parents came to Missouri. Reared on the farm in this county, he attended the county schools during the winter months until 1857, when he entered the Collegiate Institute of Shelbyville, where he took a course of instruction in the higher branches. He was preparing for the profession of law, and in 1859 he began teaching, which he continued for about two years, reading law at the same time under John McAfee, Esq. Indeed, he began the study of law in 1859, and in 1861 he was admitted to the bar, while Judge Gilcrist Porter was circuit judge. December 17, of the same year, Mr. Hale was married to Miss Daisy T. Smith, a daughter of Chamues Smith, Esq., of Pike county, Mo. The following summer he resided at Louisiana, but came to Shelby county and engaged in business with Judge Foster at Shelbina. They were successfully engaged in merchandising at that place until the spring of 1865, when Mr. Hale came to Shelbyville and began the practice of law at this place. He has since been continuously occupied with his practice, and has long held the position of one of the safe and successful attorneys at the Shelby county bar. However, it should be stated that he was out of the practice during a part of each of the years 1881 and 1882. During this time he was in Colorado occupied with mining interests. He still has valuable mining property out here, partially developed, which gives promise of profitable yields. Mr. Hale takes a public spirited interest in political and general affairs, and occupies a position of prominence in public matters. He is at present secretary of the County Democratic Central Committee. In 1872 he ran for prosecuting attorney of the county, but was defeated. He also ran for sheriff, in 1876, but was again unsuccessful. Mr. and Mrs. Hale have three children: Charley, Terrie and Harry. They have lost two. Mr. Hale is a prominent member of the Masonic order. Mr. Hale's condition is considered dangerous. LATER: Word was received here Thursday that Judge Haled died Wednesday morning. Mr. Hale was one of the oldest and most prominent men in Shelby county. Another of the ties that bind the present to the early days of this county has been broken and another citizen long known and respected has been called across the river. Very few of the older citizens but whose heart were saddened by the news that "Jim" Hale, as he was familiar called, was no more to move among the people of this county. Though, he had been in falling health for many years and his death was not a surprise, it is none the less a blow to the feelings of all who knew him, and that was most everyone in this section of the country; for be was a genial, humorous companionable man, honest and reliable; man of judgment and of public spirit. He was judge of probate for this county from 1888 till 1898. He was a good, strong speaker and a brilliant writer; and was a member of the bar of this county longer than any other man who has ever lived in it, having been admitted to practice law in 1861. He studied with John McAfee who several times represented this county in the legislature. While he was studying law he taught school to pay his way. Lllburn Hale was the father of our deceased citizen and in 1846, when "Jim" was seven years old, he came from Sullivan county, Tenn., to this county where the family ever after resided. The old gentleman had a tragic death. On his way from Shelbina to his home north of Salt river, April 2d. 1862, he fell in company with Col. Lipscomb and some federal troops going north and this side of Walksville [sic] by the old Cadwell farm the troops were fired upon from the brush and Mr. Hale and two soldiers were killed. James married Miss Daisy Smith of Pike county, Mo., in 1861, and they raised three children, Charley, Terry and Harry; the first named is in Idaho, and the last in Desoto, Mo., Terry is in Shelbyville, and all of these, the widow and three sons, survive to mourn the loss of a husband and father. Funeral services were held Friday afternoon, February 5th, 1904, at the Baptist church in Shelbyville. Mr. Hale was a member of this church. There were many of the old men at the funeral. Revs. Turner of Shelbina and Penn of Shelbyville officiated at the funeral, and his remains were laid to rest in the Odd Fellows' cemetery.
