The accident occurred nearly opposite Roadmaster Barnoske's home, about a thousand yards west of the depot. The deceased was a deaf mute He had been to see W. H. Mowder, who was working on G. W. Stout's farm, and was returning to town. The engineer, Harry Clark, saw him on the track and whistled; but did not slow up his train, it seems, at that moment; thinking that the man would step off the track in plenty of time as men generally do. But as Mr. Juber made to move toward stepping to one side the engineer applied. the air brakes but the train could not then be brought to stop until after it had struck him. The, engineer thought that Mr. Juber was walking toward the train as did also D. W. Goodson, who saw the accident, but Louis Graham and Lee Wilmering, who also saw the accident are quite positive that he was walking from the train with his back to the engine. And this would seem to be borne out by the nature and location of the wounds, the deceased's ribs on the left side being broken from the backbone, the neck and one of the fingers of the left hand being also broken. The forehead also contained bruises of a slight nature. Frank Smith and Lee Vanderloo also saw the accident, the evidence of all being substantially the same, except as to whether the deceased was walking.toward or from the train. The jury, however, empaneled by Coroner L. G. Patty, consisting of A. C. Parkinson, John A. Dixon and S. D. Henry, found that the deceased met his death by accident, that being deaf he could not hear the noise or whistle of the approaching train. Mr. Juber with his family came to Carroll county twenty-seven years ago from Clinton county and bought a farm north of town, the one now owned by Mike Grimm. Here he resided seven years, when he moved to town where he has resided ever since. He owned a little home and worked at stone mason work as a trade, though he performed other manual labor, being very industrious, honest man, and liked by everybody. He was an uncommonly cheerful man, considering his affliction, and very fond of mirth. He left three children, Frank, now of Glidden, Erastus, of Oskaloosa and James, of Cherokee, all of whom attended the funeral, it being preached Wednesday by Elder Norris of the Christian church, of which the deceased was a member, the remains being interred in the Coon Rapids cemetery. The deceased was in his 77th year. Later: Engineer Clark said on his return run Tuesday, that when he first saw the deceased he was walking eastward, from the train, but before the train struck him, he turned around with his left side to the engine. That it seemed to him that Mr. Juber had time even then, to get off the track but that he stood, seemingly paralyzed, with fright, unable to move. This precludes any possibility of suicide. It frequently happens that even strong men are overcome with fright and unable to move. Livingston, the great explorer, cites an instance of this kind relating to himself, in which a lion completely undone him, rendering him motionless and speechless.
