He had a stroke of apoplexy about two weeks ago and while he rallied for a time and exhibited remarkable vitality, his advanced age made recovery out of the question and he has been gradually failing for several days passing away at the hour stated. Judge Luther L Baxter was born in Cornwell, Vermont, June 8, 1832, and would have been 83 years old in June of this year. He was a son of Mr & Mrs Chauncey Baxter, his mother's maiden name being Miss Philena Peet. He received his education in the district schools of his native town, supplemented by private tuition, a year at Casselton Seminary and a 2 years' course at Norwich University. Commencing the study of law at 19 years of age under Lindsley & Beckwith and concluding his studies with Judge Horatio Seymour he removed to Illinois in the fall of 1853 and was there admitted to the bar in 1854, Locating at Geneva, Wisconsin he practiced his profession successfully until 1857, when he removed to Carver County, Minnesota. He resumed the practice of his profession in this state and continued it except during the term of his enlistment until 1885. Judge Baxter enlisted in the Union army in 1861 as Captain of Company A, Fourth Minnesota Volunteer Infantry and was assigned with two companies to the command of Fort Ridgeley. He remained there until March 1862 when he rejoined his regiment at Fort Snelling and was promoted to the rank of Major. In April 1862 he was ordered south with his regiment where he participated in the early campaigns, but was compelled to resign in October of that year on account of illness. He re-entered the service in November 1864 as Major of the 1st Minnesota Heavy Artillery; he was promoted to the rank of Colonel in 1865 and commissioned colonel in the same year and participated in the Battle of Nashville. He was elected to the State Senate in 1864 and was granted leave of absence to take his seat in that body at the session commencing in January 1865. Returning to the army in March he was assigned to duty as Chief of Artillery at Chattanooga, remaining there with his regiment until mustered out of service in 1865. Judge Baxter was a Democrat and as such held many positions of honor and trust. He was a Judge of Probate in Carver County in 1858; prosecuting attorney for the Fourth Judicial District in 1859; County Attorney of Scott County in 1863; Senator from Scott County from 1865 to 1869; member of the House from Scott County in 1869; Senator from 1869 to 1876; County Attorney from Scott County from 1877 to 1879; and member of the legislature from 1879 to 1881. He came to Fergus Falls in 1882 and in March 1885 was appointed Judge of the Seventh Judicial District to fill an unexpired term, the appointment being made by Governor Hubbard. He was a candidate for the office the following year, the late Judge J P Williams being the Republican nominee and was re-elected although the district was strongly Republican. He was re-elected in 1892 and 1898 without opposition and in 1904 was elected for the 4th time in the memorable campaign in which he was pitted against the honorable J W Mason of this city and Mr Valentine of Long Prairie. This was a very close election. He thus held the judgeship continuously for a period of nearly 26 years, retiring voluntarily on January 4, 1911 and being succeeded by Judge Nye of Moorhead. He was at one time nominated for congress by the Democrats of the District. Senator Nelson at that time being the Republican nominee. Baxter had served on the district bench for a great many years also died from apoplexy several years ago and was succeeded by Judge Roeser of St Cloud and as the district is a very large one and the work heavy, a third judgeship was created a few years ago. Judge W L Parsons being named for the position. Judge Baxter was three times married, his first wife being Emma Ward. They had four children of whom only one, Chauncey L Baxter survives. His second wife was Barbara Deuhs, and they also had four children of whom only one, Miss Bertha Baxter survives. His third wife was Emma Child, who survives him. His daughter is teaching in the Minneapolis schools and was summoned home by his serious illness and his son, who was for years a well known attorney here and who is now a leading attorney of Seattle, Washington, has been notified and expected to start for this city Thursday night. Judge Baxter was a Knight Templar and was the only surviving member of the Loyal Legion in this city, the late Colonel Brush and himself having been the only members of the order here. Funeral services in this city will be under Masonic auspices at 3:30 o'clock Monday afternoon and the remains will be taken to his old home at Chaska on the late afternoon train, where they will be laid at rest beside his children, the services there being under the auspices of the Grand Army of the Republic. Mr DuToit, the commander at Chaska will come to this city and with Miss Bertha Baxter will accompany the remains. He is survived by one sister, Mrs Woodbury of Casselton, Vermont.
