The deceased, who had been spending the day in Claresholm was returning to his home some time after 9:30 pm. His home being close to the C & E Railway, it is thought he took the shorter but more dangerous way riding his horse along the tracks. Train No 540, in charge of Engineer Anderson and Conductor Bassett, left Claresholm very close to the time and according to the evidence of the engineer and fireman no object was discerned upon the track until the train was about 10 telegraph poles away . The bell and whistle rang the alarm vigorously and when the train was within four poles of the object and when the engineer to his horror made out the form of a man, it was impossible to stop the train in time although everything was done to avoid striking horse and rider. The unfortuante man was thrown from the track but a short distance and the still breathing form was taken upon the train to Granum. Dr McMillan, of the latter town, found that the man had died from his injuries before reaching Granum, a wound upon his head having doubtless caused death. The horse which the deceased was riding was killed. An inquest was held before Coroner (Insp) Tucker, of the RNWMP and after deliberations which took up the entire day, the engineer of the train was exonerated from blame. A copy of the finding is given below. The deceased was a man about 37 years of age, married with a family of six small children. His funeral was held at Claresholm on Wednesday the local Mormon leaders conducting the ceremony of interment. The circumstances in which the family of the deceased are bereft, adds to the distressing nature of the tragedy. An Inquisition taken for our Sovereign Lord the King at the RNWM Police Barracks in the Town of Claresholm on the 4th day of January 1915, before R.E. Tucker one of the Coroners of our Lord the King for the Province of Alberta, on view of the body of Ottis Scott Rice, then and there lying dead and the undersigned good and lawful men being duly sworn and charged to inquire for our said Lord and King, where, how and by what means the said Ottis Scott Rice came to his death, do upon their oath say: That the deceased Ottis Scott Rice came to his death on January 2 1915 at about 10:30 pm by being struck by train No 540 near Claresholm, Alberta. We further exonerate the engineer C Anderson from all blame in the death of the said deceased.
