SHALTPSBUHG - Paul and Evelyn Culler are caught in Hie middle of another Battle of Antietam. They don't favor either side. But if legislation providing for expansion of the Anlietam National Battlefield to prevent encroachment by developers is passed, the Cullers may have to choose between leaving the farm they have worked for 18 years or acquiring the federal government as a landlord. Neither prospect appeals to them. "We just want to keep our land and go on farming it," Paul Culler says. The Cullers' farm is located on Mondell Road, adjoining part of the 705 battlefield acres the federal government already owns. It includes ground on which the bloodiest battle of the Civil War was fought. A bill introduced in Congress would authorize the U.S. Park Service to purchase 2,000 acres of battlefield land from private owners like the Cullers. It is aimed at preserving the area from the pressures of encroaching development. One housing corporation already has plans to begin construction of a 21-house subdivision on 69 acres of the battlefield. Since Washington County has no historic zoning law, any privately-owned battlefield can be developed. The Cullers don't want to develop their land. They have refused to sell to developers in the past, but they don't want to be forced to selling to the Park Service, either. "Let the government buy the farms when their owners put them up for sale." Paul Culler says, "and let the folks who want to keep their farms keep them." "If the bill is passed," Evelyn Culler says, "our farm probably will be among the first ones the Park Service will acquire." She's probably right. The Cullers' farm encompasses the 50-acre Miller Cornfield, scene of tremendous slaughter during the Battle of Antietam. In fact the cornfield is one of the sites specifically mentioned as historically important by Sen. Charles Mathias when he introduced the battlefield expansion bill. The bill was introduced in the Senate by Mathias, J. Glenn Beall Jr. and Mark Hatfield, and in the House by Rep. Goodloe Byron. It gives the owner of improved property on the date of acquisition by the Secretary of Interior the option of staying on the property until he or his spouse dies, whichever occurs later, or for a period of not more than 25 years after the government acquires the land. No matter which term of tenancy they would choose, the Cullers say, the farm still would belong to the government and not to them. The Cullers had bought their farm with an eye to handing it down to their son, Lynn, and his family. So if the government acquires the land, both families figure they will be losers. They acknowledge the possibility of buying another farm, but Paul Culler says good farmland is hard lo find these days. "This farm was pretty rundown when we bought it," he says. "The land was in poor shape, we had to build a new dairy barn and we had to make improvements to the house." Culler is 82 and he doesn't want to face the prospect of re-building another farm. The Cullers bought their historic farmland only because they lost their previous farm to the federal government. That land, on Maryland 65 north of their present farm, was condemned by the government and acquired for the U.S. Army. It is not now being used. Evelyn Culler says she and her husband have cooperated with the Park Service in keeping their farm compatible with the federally-owned battlefield area. But she says the government doesn't play fair. "the government bought the Spielman farm," she points out, "they put up the Visitors Center, yet they don't want the farmers to erect new buildings." The Cullers have opened their farm to group tours, to bullet hunters who come by the hundreds with their Geiger counters and to film companies. Mrs. Culler says a company which makes films for high school history classes approached them last year about filming some scenes in the Miller Cornfield. "They even asked if we'd plant the field in corn for shooting this September," she says The Cullers planted the corn, but they haven't heard any more from the film company. The family and other farmers in the area who want to retain ownership of their land have written to Mathias, Beall and Byron. But they don't expect the bill will be altered. "Will buying more ground give more respect to the war dead?" Mrs. Culler asks. "The government is taking our sons, our homes and our livelihood," she says. "What freedoms do we have left?"
