The presentments to the grand jury against Wise will be three charging murder and one for arson involving the night burning of his dwelling at Franconia last fall when his wife, Mrs. Nellie Virginia Wise and two daughters, Frances, 19, and Beatrice, 12, lost their lives. Wise and his son Woodrow Wilson Wise, 21, escaped. Wise was arrested after three months' investigation by local authorities. He was held for action of the grand jury last month by Judge Paul E Brown, of the County Trial Justice Court. From the March 28, 1935 issue, page 14: DEFENDANT CLEARED OF ARSON-MURDER Virginia Court Refuses to Indict Philip Wise Murder and arson charges against Philip Jacob Wise, of Franconia, Va, were ignored yesterday by a Fairfax County grand jury after it had heard the State's contention that Wise started the fire which destroyed his house and burned his wife and two daughters to death. Wise was called before the court and discharged from custody. He had been held in bond of $5,000. The fire at Wise's home occurred last October. In January he was arrested, and in March a grand jury indicted him on charges of murdering his wife, Nellie, and his two daughters, Beatrice and Frances. Wise's attorney attacked the validity of the jury and was upheld by the court, throwing out these indictments. A new jury was selected and the cases presented again. Kathleen Bond notes that although his gravestone bears the given name "Phillip," the news articles spell his name with one L -- "Philip." He married again sometime before 1940, to Nannie Simms.
