State of Kansas, plaintiff vs Elzie Dickey Statutory Rape filed 8 Sept 1913 Allen County, City of Iola Criminal Action Case No 10134 Before me G M Nelson, a Justice of the Peace of Iola, Allen County, Kansas MARY E WARFORD of lawful age, being duly sworng, on oath says: That ELZIE DICKEY on or about the ___ day of May 1913 at Iola in Allen County, Kansas, did then and there unlawfully, feloniously carnally knowing a female under the age of eighteen (18) years, to wit: LEONA WARFORD of the age of sixteen (16) years signed Mary E Warford filed 19 Aug 1913 sentencing 22 Sept 1913 ....defendant upon his plea of guilty as charged ....ordered by court that the defendant, Elzie Dickey, be imprisoned in the Kansas State Industrial Reformatory until discharged...for a no longer period than 21 years from this date, to wit: September 22, 1913 ...to wit: Elzie Dickey to be imprisoned in the Kansas State Industrial Reformatory at Hutchinson, Kansas...that the said Elzie Dickey be, by the Sheriff of Allen County, Kansas, Hoover Kerr, delivered to the Superintendent of said Kansas State Reformatory 6 Sept 1913 Railroad fare from K. Dickey, plaintiff vs Flossie Gardner Dickey, defendant State of Kansas, Allen County Petition for divorce ...he is resident of Iola, Allen Co Kansas ...plaintiff and defendant were married to each other on the 15th day of August, 1913 at Kansas City, Mo. That the plaintiff is nineteen years of age and the defendant is eighteen years of age. That there are no children by this marriage. That plaintiff and defendant were both minors at the time of their marriage. That shortly after their marriage while living at Valley Junction, Iowa, the defendant left and deserted the plaintiff with the intention of abandoning him and declaring that she would never live with the plaintiff again and she came to Kansas City and later to the home of her parents in Iola, Kansas. That since that time the plaintiff and defendant have never lived together nor resumed the relations of husband and wife. That on returning to Iola, Kansas the defendant immediately resumed her maiden name Flossie Gardner and has continued to be known under that name and she has openly declared that she will never live with the plaintiff again and that she hates him. ...That the defendant has been extremely cruel to the plaintiff. That the defendant has for a considerable time been going with a certain young man and has declared that she intends to marry him. That she has been often seen in the company of other young men. dated 11 August 1914 ...you are hereby commanded to notify Flossie Gardner Dickey that she has been sued by Elzie Dickey, a minor, by his father and next friend, Wash. Dickey ...she answer by 30th day of August, 1914 dated at Iola, Kansas 1 Aug, 1914 Divorce Proctor's Report ..Frank R Forrest county attorney in and for Allen County, Kansas That plaintiff and defendant were married as alleged in plaintiff's petition under the circumstances that led to plaintiff's arrest in the case of the State of Kansas vs Elzie Dickey, Case No 10134 and subsequently said Elzie Dickey upon a plea of guilty of charge of statutory rape was sentenced on Sept 22, 1913, to the State Reformatory at Hutchison, Kansas. On the first day of June 1914 he was paroled from said institution and is now out on parole..... Oct 30, 1914 Tom Christy subpoenaed as a witness in behalf of the plaintiff Journal entry (FINAL DECREE) Oct 24, 1914 having duly considered the pleadings and evidence and argument of counsel and being fully advised in the premises, I find the issues in favor of the plaintiff and against the defendant, and find that the plaintiff is entitled to a divorce from the defendant because of the fault of the defendant. It is therefore considered, ordered, adjudged, and decreed that the plaintiff be granted and divorce from the defendant because of the fault of the defendant. Decree of divorce not to become operative until after six (6) months from this case Oct 24, 1914. Plaintiff to pay costs of action. (Flossie remarried to Floyd Marple 26 April 1915) Elzie has baby with Leona Warford and it dies 6 Dec 1913 Elzie remarries sometime between 1915 and 1917 when registers for the draft 1917. No issue with Nellie Opal Gay. W. Dickey and Frank Gay post bond for $2000 (FRANK GAY WAS NELLIE'S FATHER) Nellie Opal Dickey is of age 28 August 1919 * In the Probate Court of Said county in the matter of the estate of Nellie Opal Dickey, minor heir of Elzie Monroe Dickey, deceased. And now comes Nellie Opal Dickey and represents that she is the minor heir and wife of Elzie Monroe Dickey, who died October 15, 1918 and her name and age is as follows: Nellie Opal Dickey age 18 years, May 17, 1918 minor heir of Elzie Monroe Dickey, deceased, late of the County of Allen and State of Kansas. That the said deceased left her insurance money payable in monthly payments of $52.00 from U. S. Government a total amount during her minority $1667.50 ...prays that Ella Dickey may be appointed guardian of the person dated 27 Dec 1918 After 1920 Elzie's parents move to Emporia, Kansas where they are found in the 1930 census.
