His ruling was made when the ordinance was offered in defense of Henry Rizzi, on trial before a jury on a manslaughter charge in connection with the death of Seymour Flood Sr. last July 19. Seymour Flood Jr., son of the accident victim and driver of the car in which his father was fatally injured, had testified he was 15 years of age. Defense Attorney Joe Albi pointed out the section of the new city ordinance which forbids any person under 16 years operating a motor vehicle on the city streets. Deputy Presecutors Carl Quackenbush and I. M. Carroll then cited the state law which allow such persons to operate cars when accompanied by their parents or guradians. Part of Law Void "This section of the city ordinance is null and void because the city has no authority by law to enact ordinances which conflict with the state law," Judge Witt ruled. Young Flood told the jury he was driving north on Division and was crossing Sprague with a green light when his car was struck and turned over by the Rizzi car. Mrs. Floow, widow of the accident victim, said the traffic light was green for north and south bound traffic when their car entered the intersection. They were on their way to church when the tragedy occurred on Sunday morning, July 19, she said. L. R. Stevens, city superintendent of alarms and traffic lights, told the jury of the operation of the automatic traffic lights at the corner. Defense counsel questioned him at length about the green arrow, which permits cars from the east to turn north at Division against red signal which stops through travel. Rizzi mistook the arrow for a clear signal for through travel, the defense contends. ∼ The Spokesman-Review (Spokane, Washington) 23 Sep 1936, Wed Page 6 DOUBLE LIGHTS CONFUSED HIM Red and Green Together at Intersection Blamed in Manslaughter Trial Traffic lights which showed red and green at the same time confused him at the intersection of Sprague and Division July 19, when Seymour Flood of Espanola was killed in a car crash, Henry Rizzi, accused of manslaughter, testified before a jury yesterday in Judge Fred Witt's court. Rizzi, who is from Wallace, Idaho, was driving west on Sprague avenue when his car struck the Seymour Flood car traveling to the north. Seymour Flood Jr., 15, was driving his father's car, which was upset. Testimony of the defense witnesses was that the Rizzi car was traveling at from 15 to 20 miles an hour in the intersection. There was testimony that many cars have been wrecked at the intersection in the two years that the double light has been in operation. Two Way Light Signals There is a green arrow which indicates one may turn right at the time the other light shows red and halts traffic. Defense efforts to shift the blame to Seymour Flood Jr. failed when Judge Witt ruled the state law governs and that the city ordinance is invalid where it conflits with the state law. The city law does not permit driving by persons under 16 years of age, but the state law permits it if they are accompanied by their parents. Deputy Prosecutors Carroll and Quackenbush represent the state. The case will be argued today.
