Boone, Aug. 21 - Friday morning about 2 o'clock a small but tragic fire took place at the home of Thomas J. Smalley, just north of the Boone driving park. There was no telephone in the house and before the fire department could be called Mr. Smalley, a man about 76 years old, was found dead, apparently suffocated. Shortly after 3 o'clock in the afternoon, County Attorney F. W. Ganoe caused a warrant to be issued for the arrest of Arthur Lumley (FAG 120798967), of Des Moines, on charge of murder in the first degree, he being charged with killing T. J. Smalley at the latter's home. Lumley was placed in custody at once as the officers had been shadowing him since he was called before the coroner's jury... (Arthur was in the Iowa State Penitentiary at Fort Madison for this crime, during the 1930 and 1940 census) **** While the article goes on to suggest that the coroner's jury found death caused by the fire, Thomas' death certificate says he was "murdered", with no mention of a fire. The Des Moines Register of July 1951 indicates he was still incarcerated.
