AL CAPONE'S PROSECUTOR ONE OF THE U.S.'S ‘SECRET SIX' The attorney chosen by President Herbert Hoover to prosecute the government's income tax evasion case against Al Capone has died here. William J. (Bill) Froelich, 78, had been one of the Justice Department's "Untouchables" for only two years when Hoover placed him in charge of the Capone prosecution. As a young assistant in the office of the attorney general he had become one of a group known as the "Secret Six", which was assigned to prosecute prominent cases throughout the nation. Besides the Capone case, Froelich handled liquor conspiracy prosecutions against Helen Morgan, the Ziegfeld star who owned a speakeasy and Texas Guinan, famed nightclub hostess of the roaring ‘20's. Froelich's 1931 prosecution of Capone led to the gangster's indictment on 21 counts of income tax evasion. It was the first tax case in history in which a defendant was convicted solely on the evidence of the amount of money he had spent. Capone was sentenced to 11 years in prison but was released from Alcatraz in 1939 because of poor health and never served out the time. He died in 1947 of complications from syphilis. After leaving the Justice Department, Froelich turned to corporate and tax law, helping to draw up the charter of the Federal Deposit Insurance Corp., which was created by the Banking Act of 1933. He later served as its first chairman.
