His death was due to an attack of inflammation of the bowels. Mr Marshall is survived by a widow and 3 children, Lemuel of Troy, William of Columbus and Mrs Powers of St Paris. Oct 14, 1905 A petition has been filed in the common pleas court by LD Marshall against Mary M Marshall, Lem Marshall, William Marshall and Savannah Powers and concealed in the technical terms with which it bristles is a story upon which the novelist might write a book. The plaintiff avers that he is the owner of 167 acres of land in Jackson Township which he acquired by purchase from Catherine Marshall. In 1883, he executed a deed for the premises to William Marshall and instructed the instrument to his keeping. According to an agreement entered between them at the time of the transaction, this was not to be considered as a delivery of the deed and no title was to pass, neither was the deed to be recorded unless William Marshall should survive the plaintiff to this action. A number of years later this agreement was entirely revoked and William Marshall told the plaintiff that he had destroyed the deed and that it would never he heard from again. He supposed that such was the fact and had no information that the deed was not destroyed until after the death of William which occurred Oct 1, 1905. He then learned that the deed was still in existance and that it was in possession of the defendants who are the heirs of William. He also discovered that on Oct 10 the defendants presented the deed to the recorder of Champaign County for record and unless he is aided by the court his title in the premises will be lost. He therefore prays the court that the deed may be decreed to be null and void and no effect in law, that his title to the premises may be quieted and that the defendants may be perpetually enjoined from interfering with his peaceable possession of the property which is a valuable farm.
