Canby, 63, a Rockville lawyer who served as president of the Montgomery County Bar Association in 1977, died Sept. 4 on the island of St. John in the Virgin Islands after an apparent heart attack. He was stricken while scuba diving. Mr. Canby. who specialized in real property and contracts law. had been a partner in the Rockville law firm of Miller Miller & Canby from 1963 until retiring in 1991. Since then, he had been of counsel to the firm. He had been a member of the board of governors of the Maryland Bar Association and a fellow of the American College of Trial Lawyers and had served on the Maryland Commission on Insurance Code Revision. Over the years. Mr. Canby served as general counsel and on the boards of the Sandy Spring National Bank. the Mutual Insurance Co. and Montgomery General Hospital. He had served on the board of trustees of the Montgomery County Treatment and Learning Centers and the Montgomery County chapter of the American Red Cross. Mr. Canby. a resident of Brookeville, had bred state champion Black Angus beef cattle and had been active in Angus breeders associations. He was a member of the Montgomery County Farmers Club. Mr. Canby. a Navy veteran who was born in Sandy Spring, graduated from Washington & Lee University in 1952 and the University of Maryland law school in 1958. He was a past president of the law school alumni fund. Before beginning the private practice of law in 1963. he was an associate Montgomery County attorney and clerk to Maryland Court of Appeals Chief Judge Stedman Prescott. His first wife. Nancy Lee Canby, died in 1990. Survivors include his wife, the former Judith Warren, and two children from his first marriage.
