Description	:	The cemetery is located across Clear Lake southwest from DUKE and contains the graves of Sarah Fitzgerald Fenn, John Rutherford Fenn, Rebecca Williams Fenn, members of the Williams family, Daniel Perry, Perry children and Mrs. Hubbard. Probably Louisa Ann Morton Perry and her mother Nancy Spencer Morton are also buried in this area, as well as David Fitzgerald. In 1901, W. P. Hamblin, son of Jane Hogue Hamblin Perry, wife of Daniel Perry, deeded a part of the old Perry homestead, to be set aside as a cemetery. The cemetery is referred to as the DUKE Cemetery; there are no headstones in the cemetery. Cemetery Dedication-Dated September 14, 1901-Filed May 28, 1902-Recorded Vol.23, page 266 Fort Bend County Deed Records W.P. Hamblen to Whom it may concern and J.R. Fenn I, W.P. Hamblen one of the heirs of Jane H. Perry she now dec'd but in her lifetime relict & widow of Dave Perry deceased and of as such heir is now the owner through and by partition of a part of the Old Fitzgerald grant in Fort Bend County known as the Old Perry Homestead the part thereof owned by me by me being out of the south west portion that is to say the south one half of the Western two thirds of the lands owned by my mother Jane H. Perry aforesaid at her death, she taking the same under the will of Dave Perry deceased said partition was made between myself and sisters as will appear by the records of Fort Bend County and heretofore during the lifetime of said Dave Perry quite a number of the members of the family of said Perry and of the Williams family of John R Fenn and wife Rebecca M. Fenn were interred on the premises owned by me out of my respect for the remains of the said Perry family and in consideration of my regards for the said Williams family and for John R & Rebecca M. Fenn do now hereby dedicate in perpetuity insofar as I may or can do the following portion of said land as the last resting place of the dead aforesaid to-wit: Near a large live oak tree standing in said piece of land hereby dedicated a gas pipe has been placed two inches in dia. eighteen feet from said Live being the south east corner Thence West one hundred feet an iron bar Thence North one Hundred feet an iron bar a live oak six inches in dia 27 feet distant bears south Thence East One hundred feet an iron bar for corner a stooping live oak 3 1/2 feet in dia. bears S of West Thence One hundred feet to the beginning corner the said piece of ground intended to be a square of one hundred on each side this dedication is made upon the following conditions First it is a private dedication and shall not enure to the public Second that no dead bodies shall ever be buried in said ground described herein by any person or persons including in this prohibition the members of all the families herein before named and their descendents except that J.R. Fenn and his wife Rebecca may be buried there. Third that no monuments shall ever be enacted over the dead now buried on said ground Fourth a permanent fence may be placed around said ground by any of the said families or their descendents Fifth access for said families or their descendents is hereby granted to said ground at reasonable times but no permanent ways shall be made and no case shall such persons visit in vehicles of any character but shall pass through the surrounding land on foot but should I sell the surrounding land the owner may grant whatsoever privileges he deems proper I reserve the right to visit the said ground in any manner I please.
