He fired three shots, two while Carrico was sitting in the car and one after he had jumped out and crawled under the car. Immediately after the shooting Wehenkle threw down his gun and ran out the back door into the alley, turning east. He took refuge in the Ezra Moon home, where a crowd gathered. The man offered no resistance when Marshall Ashburn took him into custody. He was at once taken to the county jail at Madison. Wehenkle told the Citizen reporter that Carrico had been the means of breaking up his home and it was for this reason he had shot him. He said his home was at Newman Grove and that his parents lived on a farm west of Madison. After his wife left him he spent a year in South Dakota where he lost everything he had and returned to Newman Grove last fall. He came to Tilden a couple of days before the shooting. Attaches of the garage say that Wehenkle had spent considerable time in the garage and seemed to be on friendly terms with Carrico. Wehenkle's wife is a daughter of Cornelius Schmidt, who recently retired from the operation of the Tilden Hotel. Word has just reached us that Carrico died in the Tilden Hospital where he was taken after being shot. His parents reside in Norfolk and he had been working in the Tilden Garage since last August. THE LINCOLN STAR; Lincoln, Nebraska; Thursday, July 1, 1926; front page QUARREL ENDS IN A KILLING -------------------------------------------------- John Wehenkel Arraigned For Slaying Of Arthur Carrico As Latter Lay Under Car In Tilden Garage -------------------------------------------------- Madison, Neb, July 1. --(By the Associated Press)-- Arraignment of John Wehenkel, who yesterday, shot and killed Arthur Carrico as the latter lay under an automobile at Tilden, was set for this afternoon in county court. He is charged with first degree murder. Wehenkel's wife, from whom he was separated, filed for divorce Wednesday. Wehenkel had charged his wife with misconduct with Carrico and a quarrel of long standing had existed between the two men. Wehenkel is alleged to have entered the garage where Carrico worked as a mechanic and to have shot him as he lay under a car. The owner of the garage attempted to drag Carrico from under the machine and Wehenkel shot again. Wehenkel then ran to the home of a relative who advised him to surrender. County Sheriff Smith, notified of Wehenkel's arrest, met him and Tilden officers and brought him to the jail here. Mrs. Wehenkel, in her divorce petition, alleged desertion and non-support. THE LINCOLN EVENING JOURNAL; Lincoln, Nebraska; Friday, May 3, 1929 page 3 JOHN WEHENKEL IS GIVEN HIS FREEDOM Slayer of Arthur Carrico Who Was Sentenced to State Hospital, Declared Sane MADISON, Neb.,--(UP)--Sentenced two years ago to life imprisonment on a murder conviction and later sentenced to the state hospital after a re-trial, John Wehenkel, Newman Grove, confessed slayer of Arthur Carrico of Tilden, is free on the order of County Judge E. L. Reeker. He was declared sane Thursday by two doctors and two county law enforcement officers. His lawyers brought habeus corpus proceedings proceedings and proved he was sane. The slaying occurred June 30, 1926, after Carrico is alleged to have broken up the Wehenkel home and then refused to support Mrs. Wehenkel and her children. Wehenkel was convicted of the murder at his first trial and was sentenced to life imprisonment in the penitentiary. After he had started serving his term, the supreme court granted him a rehearing and a jury aquitted him on grounds of insanity. Ordered to the Norfolk State Hospital, he was placed in the county jail because of crowded conditions in the hospital. NEBRASKA STATE JOURNAL; Lincoln, Nebraska; Saturday, November 13, 1939; page 2 HUNT CLUES IN SLAYING Nebraskan Has Father's Body Exhumed PIERRE, S.D.--(AP)--Chief Agent Fred Searis of the attorney general's office said the body of John Wehenkel, 57 year old Tripp county farmer, whose death last July was termed suicide, had been exhumed at the request of his son, who suspects his father was slain. Wehenkel was found dead July 16 on the kitchen floor of his farm home. There was a bullet hole in his body and a large caliber rifle from which one shot had been fired, nearby. Kenneth Wehenkel, about 25, Norfolk, Neb., told Searis he believed his father might have been murdered. He revealed that his father had been tried and convicted of killing a man in Nebraska and had served one year in prison before a new trial gained him his freedom. The son believes his father's death was connected with the Nebraska slaying. The bullet taken from Wehenkel's body has been sent to the Federal Bureau of Investigation in Washington for examination. NORFOLK, Neb.,(AP) John Wehenkel, whose body was exhumed at the request of his son, Kenneth, who suspects his father was slain, was tried in Madison County District Court for the slaying of Arthur Carrico, Norfolk, whom he was accused of shooting to death in a Tilden garage in the summer of 1926. At his first trial, Wehenkel was found guilty of first degree murder and sentenced to life imprisonment. After serving about a year, he gained a new trial, in which he was aquitted. At the time of the slaying, Wehenkel was living in Newman Grove. On being aquitted, he went to South Dakota to make his home.
