PERRY DIES AT HOME IN JEFFERSON Benjamin Franklin Perry, 72, former judge of Ashtabula County common pleas court, and father of Probate judge, J. Philip Perry, died at his home in Jefferson at midnight Tuesday, after a serious illness of several weeks. The death of Mr. Perry removes an outstanding citizen from the county. He was born at West Andover, October 25, 1858. He had been suffering from heart trouble and his condition had worsened for the last three weeks. Funeral Friday Funeral services will be held at 2 p.m. Friday at the Jefferson Congregational Church. Burial will be in Oakdale Cemetery. Funeral services will be conducted by Cache Commandery, of Conneaut, of which he was a member. Aside from honors earned by him, Benjamin Franklin Perry was a man deeply beloved by his family, by the people of Jefferson, and by all who knew him. Sincere, friendly, sympathetic and a man of high character and idealism, the spirit of this beloved man has not only been impressed on the people of Jefferson, but more widely upon those who knew him in the county and state. By his fine example the family of five sons and daughters have been eminently fitted for public service. The deceased was the son of Lieutenant B. F. Perry of West Andover. The father served with distinction in the Civil War, while the wife, with her family of small children, remained at home carrying on the farm work at West Andover. The identification of the father of the deceased Judge Perry with the Black String society was important in the history of the nation. This society was formed in a sugar house on the Perry farm to resist the arrest of any persons who were connected with the John Brown raid. The society was secret and grew to a nationwide society of more than 10,000 members. Educated In County The deceased received his education under the noted Jacob Tuckerman, principal at Austinburg. He was one of the students who went from Austinburg to New Lyme with Professor Tuckerman when he became principal of New Lyme Institute. B. F. Perry graduated from that school in the early '80s. In 1882 he was appointed school examiner of the county, holding that position several years. He was married to Miss Charlotte H. Beach, of Kelloggsville, December 25, 1885. She was a student at the Grand River Institute, Austinburg, where the acquaintenanceship was formed. The first official duties of Mr. Perry were those of county clerk. He served in this capacity from 1888 to 1894. He commenced the study of law in 1890, in the office of Congressman Northway, and was admitted to the bar in 1896. The firm became that of Northway and Perry. After the death of Congressman Northway in 1898, Mr. Perry formed the partnership with J. W. Roberts, Judge of the court of appeals, the firm being known as Perry and Roberts. Later A. C. White was admitted and the firm became known as White, Perry and Roberts. A later partnership with Ex-Probate judge C. A. Hitchcock was formed, the firm becoming that of Perry, Hitchcock and Perry. The junior partner of the firm was J. Philip Perry, the present probate judge. Mr. Perry was appointed to the common pleas bench in 1921 by Governor Harry D. Davis, to fill the unexpired term of Judge Roberts, who was seated on the Court of Appeals bench. Completing the unexpired term, Judge Perry was returned to the bench by Ashtabula County voters. In 1925 he left the bench, retiring to his practice, being senior member of the firm made up of Judge Perry and sons, J. Philip Perry and Stephen F. Perry. The sterling character of B. F. Perry brought to him a legal practice of high order. Important cases in which the letter of the law was involved were brought to him. These were cases of importance which involved the higher sensibilities of an attorney of a high order. Active As Mason Not only active in public affairs, the deceased was a devoted member of the Masonic fraternity. He was a 33rd degree Mason. Twenty years ago he served as district lecturer of the northeast Ohio district. In this capacity his son, J. Philip Perry is now serving. The deceased was a Grand Master of the Grand Lodge of Ohio in 1909, and served as Grand High Priest of the Grand Chapter of the state in 1921 and 1922. At the time of his death he was president of the Scottish Rite Masons of Ashtabula County. He served on the rules committee of the Grand Lodge in 1930, and for more than 20 years, was active in the conduct of legislative matters of the Grand Lodge. The deceased leaves his wife and children: Mrs. Laura Arner of Washington, D. C.; Miss Clara L. Perry, domestic science teacher in Cleveland schools; Probate Judge J. Philip Perry, Jefferson; Miss Ruth E. Perry, head of the physical training department of Hood College, Frederick, Maryland; Stephen F. Perry, clerk of the board of elections, Ashtabula County; and three sisters, Mrs. Clara Wilder, West Andover; Mrs. Mary Ives of Geneva, and Mrs. Marcia Hill of Cleveland. A brother, Dr. F. E.
