Philip Perry, judge of the Ashtabula County Probate Court 30 years prior to his retirement in 1961, died at 8:24 p.m. Friday in Ashtabula General Hospital. Private services will be held Monday at the Miller Funeral Home in Jefferson. Tall, ramrod straight in bearing, his hair snow white in his later years, and formal in speech, the judge personified the traditional concept of a magistrate. The aura of dignity was not merely an appearance. He commanded respect of thousands who appeared before him and of the public who returned him to office six times after his initial election in 1929. Born here March 28, 1890, the son of the late Benjamin F. and Charlotte Beach Perry, he lived in Jefferson all his life. His father was judge of the Common Pleas from 1921 to 1925. Judge Perry was a graduate of Oberlin College and the University of Michigan Law School. He practiced law with his father from 1914 to 1920, and with his brother Stephen and Judge Charles A. Hitchcock from 1920 to 1929. From 1919 to 1928 he was clerk of the County Board of Elections. A 33rd degree Mason--the highest honor of the order—the judge was chosen Grand Master of the Masonic Grand Lodge of Ohio in 1936. In 1941 he was chosen worthy grand patron of the Grand Chapter of Ohio, Order of Eastern Star. He was a member of Tuscan Lodge 342, F.&A.M., Jefferson Chapter 141, R.A.M., Conneaut Council 40, R.&S.M., Cache Commandery 27, Knights Templar, Lake Erie Consistory, A.A.S.R., Cleveland, and the Red Cross of Constantine. Professionally he was a member of the Ashtabula County Bar Assn., Ohio State Bar Assn. and a director of the Jefferson Banking Co. "Fifty interviews is an easy day," Judge Perry to a reporter as he began his second term in 1933. He added, "Each interview has an important bearing on some life, and often times on lives associated with the individual." During the next three decades many duties of Probate Court were transferred to other courts--land appropriations, liquor violation cases, direct responsibility for aiding crippled children and the issuing of certain types of licenses. But the workload did not diminish. As the population of the county doubled, the demands of the office increased proportionately. His duties included the handling of all matters pertaining to acts of juvenile delinquency and the mistreatment of children, adoptions, settling of estates, issuing of marriage licenses and a host of domestic legal matters which are seldom in the limelight. Public attention was more often focused on the functions of Juvenile Court of which he was concurrent judge. And he often spoke out on delinquency. "Lack of respect," he contended, "is the basic cause of delinquency. Youth simply does not respect persons and property as it once did." The door stop in his private office was a large stone a youth had hurled through the stained glass window of an Ashtabula church. He was married September 15, 1936 in Ashtabula to the former Annette Mundy. Survivors include his wife, two sons, John Philip Perry, West Acton, Mass. and Richard Lyman of Chevy Chase, Md., one daughter, Mrs. Richard(Phyllis) Westerman, Evansville, Ind., three sisters, Mrs. G.B.L.(Laura) Arnet, Washington, D. C., Miss Clara Perry, Jefferson, and Miss Ruth Perry, Washington, D. C. and six grandchildren. He was preceded in death by his first wife, Irene, October 19, 1933, and a brother, Stephen, April 5, 1961. Private funeral services will be held Monday at 2 p.m. at the Miller Funeral Home in Jefferson. Rev. John F. Cuthbert, pastor of St. Peter's Episcopal Church of Ashtabula, will officiate. Interment will be in the family plot in Oakdale Cemetery. No calling hours will be observed. The family request memorials be made to the American Cancer Society.
