Further evidence was taken in the Police Court, Maryborough, yesterday, in the case in which William Prohaska (aged 19) stood charged with unlawfully killing Charles Voss at Howard on December 21 last. Senior Sergeant Power conducted the case with Mr. Brucewell, P.M.; in the Bench. Evidence was tendered by Hugh Sylvester McLelland, medical practitioner and also Government Medical Officer, stationed at Maryborough. Dr. McLelland said that he saw deceased Voss after the ambulance car had brought him into the Maryborough General Hospital. Deceased was unconscious and did not regain his faculties. He died about five minutes after being examined by witness. The condition of the deceased was probably caused by haemorrhage. The next day (Sunday), witness, as Government Medical Officer, conducted a post-mortem. The cause of death was haemorrhage in side the brain. The skull was not fractured. There were a number of abrasions about the chest, back, and shoulders. These could have been produced by ordinary blows not necessarily hard. A blow delivered in the boxing gloves produced in court could have caused the haemorrhage. It would not follow that there must be abrasions to produce such a result. The haemorrhage might have been caused by a blow on the chin, or might have been the result, of the head striking the ground after a blow. There was no evidence on the head to show that it struck the ground. All the other organs of the deceased were healthy. When deceased was brought in to the hospital no medical aid could save him. Benjamin William McKay, an ambulance bearer, gave evidence as to being called to Howard, and to finding deceased unconscious at the residence of his father. Witness and a nurse rendered all the assistance they could, but deceased did not regain consciousness. This concluded the case, and the charge having been duly read to the accused, he pleaded not guilty and said that he had nothing to say. He would reserve his defence. The Bench committed him to stand his trial at the next sittings of the Criminal Circuit Court at Maryborough on March 2. Bail was allowed as before, with one surety of £50, and two of £25— or one of £50.
