I David McBrayer of the county and state afore named, knowing the certainty of death being weakly in bodily strength but in my proper sneses, I am thought fit to make and constitute in writing put this my last will and testament (viz). Item 1st I give and divise to my beloved wife Delila the house, tract of land whereon I now live including a part of the tract of land I bought from Edmund Jones running with line and craping(?) Lees Branch north to a large red oak, Hamilton's corner thence with Jones line east to my own corner and one negro boy named Calvin, a negro woman named Harriett and children (named Demps, Eliza, and the boy which is not named and all my stock of every kind that she may think proper to keep and two notes of hand two hundred dollars each on Rodney Toms which is not due and all my household and kitchen furniture inclusive and my carriage and harness, all my farming tools inclusive and empower her to make my children (viz) Edy, David, and Ruben McBrayer equal in household and kitchen furniture to those of my children which left me and received those necessaries. Item 2 I give and devise unto my daughter Martha Weakes to be paid over to her out of the first monies collected thirty four dollars and 50 cents. Item 3 I give and devise unto my daughter Edy one negro girl named Catharine and one fourth part of the tract of land whereon I now live to her and the lawful heirs of her body forever agreeable to the provisions herein after made and one house and one woman saddle worth twenty dollars, one cow and calf, one sow and two pigs. Item 4 I give and devise to my son David one negro boy named Peter also a tract of land containing two hundred acres more or less known as the Dowry Land of the Widow Caywood, one cow and calf, one sow and pigs and two one year old hogs. Item 5 I give and devise unto my son Ruben one negro boy named Toliver one two year old filly which he now claims and if she should die before he comes to the age of twenty one that his mother as my executor procure him one of equal value with those my elder children have received. Also one mans saddle and bridle and blanket worth fifteen dollars and twenty-five dollars worth of clothing, his choice of one cow and calf, one two year old hog, six months schooling and half of the tract of land whereon I now live including the Dwelling house and out buildings taking in the division herein after to be made the land taken by the north and south lines which I bought of Edmund Jones, a part of Caywood Tract with due regard to the valuation of two intelligent and uninterested freeholders, and I further devise and give unto my daughters (viz) Edy and Milly and the lawful heirs of their bodies the other half of my land not otherwise disposed of agreeable to valuation, equal to each and the division to be made by the freeholders as above mentioned after the death of my beloved wife Delila. Item 6 I give and devise unto my granddaughter Drusilla McBrayer, daughter of William McBrayer which now lives with us, one Negro girl named Lindy, one cow and calf, one years schooling, ten dollars worth of dressing and further that all my remaining property not disposed of in this will be sold at public sale on twelve months credit and to be equally divided between all my children (viz) Louiz(?), Narcissa, William, Robert, Margaret, James, Martha, Edy, Elisha, David, Milly and Reuben and further at the death of my wife Delilah the ? of the property given to her in this will and its increase be sold at public sale on a credit of twelve months, the proceeds equally divided between my before named twelve children with this provision that my son James account to the rest of the legatees one hundred and fifty dollars which he is indebted to me, being the balance of the price of a negro boy I sold him named Ben and lastly I do hereby constitute and appoint my son-in-law Howsen Harrel and my son Elisha my lawful executors to all intents and purposes to execute this my last will and testament in witness whereof I have hereunto set my hand and seal this 29th day of September AD 1842.
