It arose in Ellifritz case Creditors of Joseph Ellifritz having judgments levied on the residence on South Street. The wife made demand in writing of the Sheriff for allowance of homestead rights, and her claim was allowed. As the property could not be divided with infury, she was put on rent under a provision of law for such cases. Attorneys for creditors moved to set aside allowances on the ground that Joseph Ellifritz and wife were not living together and that the husband, as the head of the family, had abandoned the homestead before the levy was made. That the wife's right was derived entirely from the husband, and that as he had no right she had none. That it was not a question of his failure or refusal so as to give her the right, but an abandonment pure and simple. The creditors were represented by Steel & Hofsett as attorneys. It was contended by C. H. Collins, as attorney for Mrs. Elizabeth Ellifritz, "that the desertion by a husband of his family, leaving them in the occupancy of the homestead if not an abandonment. That the presumption of law is that he continues a wanderer without a home until he returns to his duty and his family, and that until he has provided or chosen a permanent residence elsewhere to which he has invited his wife to come, she still holds her homested rights. That it is not in the power of a husband by absconding to deprive her of the right to a homestead under this statute which was intended for the benefit of the family only, and not the debtor." The authorities on each side were submitted to the Court, and Judge Newby took the case under advisement. "The News-Herald" Hillsboro, Ohio, November 7, 1895, Image 1 A Sad Death There was a thrill of sympathetic sorrow throughout the entire community when it was announced Monday morning that Mrs. Joseph Ellifritz had passed from earth to her better home. Her life for some time has been one of pain and trouble, and there can be no doubt, prepared as she was for the change, it was a welcome one to her Christian soul. For years she has suffered with serious heart troubles, and later, these were complicated with other maladies. Though apparently better Saturday, she grew rapidly worse Sunday, and during the night, passed peacefully away. The funeral services will take place today. Our tenderest sympathies are extended to her sorrowing children, Mrs. W. F. Kibler, Misses Grace and George, and her son Frank. Furnished by Marianna Kerns Morgan 7/30/2017
