OLDHAM, 42, of Columbia. About two hours earlier just south of the Moniteau Bridge nine miles north of California. A coroner's jury that met at 9:30 a.m. yesterday ruled after hearing all of the available testimony in the case that Mr. SCHLUP death was due to an unavoidable accident. The accident happened about 9 a.m. after Mr. SCHLUP, had walked from his home, about a mile east of the Moniteau bridge, to Highway 87. After reaching the highway he was attempting to flag a ride south to California. A car driven by L. H. THIEMAN, of Boonville, coming south down the Zaugg Hill started stopping to pick up Mr. SCHLUP and came to a halt about 40 feet south of the road where Mr. SCHLUP was standing. A second vehicle, a panel truck owned by the red Star Yeast Company and driven by OLDHAM was following the car driven by THEIMAN. The driver of the truck started stopping and marks left on the blacktop road indicated that he skidded about 200 feet before losing control of the truck. The truck in an attempt to avoid hitting Mr. SCHLUP swerved and struck him with the rear part of the truck before finally going into the ditch to the east of the road, where it turned over once coming to rest on its wheels. Mr. SCHLUP was taken by ambulance to the Latham Hospital where it was found that he had received a broken left leg. possible internal injuries, and a severe head injury. His death was attributed to the head injuries. The driver of the panel truck suffered from minor abrasions , bruises and shock and was released after treatment. According to testimony, presented before W. G. HEIDBREDER, who was acting coroner in the absence of Dr. Kenyon LATHAM. THIEMAN said he saw Mr. SCHLUP signaling for a ride and started stopping, finally halting his car with about two thirds of it on the shoulder about 40 feet south to the place where Mr. SCHLUP had been standing. At the time he said he saw the truck turn over to the east of him but did not see the impact. The driver of the truck told the jury that he was driving behind the first car at a speed somewhere around 45 miles an hour and started stopping, However before he was able to stop Mr. SCHLUP started to move across the road to the first car and he was unable to avoid striking him. Mr. SCHLUP was born June 11, 1887, the son of Jacob and Isabell SCHLUP, at his farm where he lived all of his life. He is survived by a brother Henry, who lives northeast of Jamestown, a sister Mrs. Lena VOIGHT, of California, three sons Uel, of Butte, Mont., Leroy, who lives at the home farm, and Harold, of Independence, MO., six grandchildren. He had been a widower since the death of his wife 32 years ago. Services will be held at 2 p.m. today (Thursday) at the Evangelical and Reformed Church at Jamestown, under the direction of the Bowlin Funeral Home. With the Rev. Irvin STEGNER, officiating and burial at the church cemetery. Pallbearers will be Bernard, Willie H., Elmer and William H. SCHLUP and Melvin MCDONALD and Lloyd VOIGHT.
