Overbrook Citizen, Thursday, June 12, 1924, page 1: Hardesty Kills Henry Hupp At a little before 11 o'clock Tuesday morning after a short argument, Frank Hardesty, a farmer who lives 4 1/2 miles north of Overbrook, shot and killed Henry Hupp, another farmer in the same neighborhood, in the road close to the Hardesty home. Hupp was working with a road grading gang under Del Herlan at the time of his death. Monday afternoon as the road gang came up to the Hardesty farm, they came onto some rocks piled into the ditch for crossings and they removed those that were on the east side of the road. Hardesty came out and he and Herlan, the gang boss, had some hot argument, calling each other names, which was followed by a fist fight. Then Hardesty went back to the house saying to Herlan, "You-son-of-a------, I'll see you tomorrow." This ended the trouble for Monday. Tuesday, as the road gang came along, Mrs. Hardesty was sitting on the north end of one of the rock crossings that was in the ditch. The men intended to go on through the crossing, but Mrs. Hardesty wouldn't move and the wheel of the first grader was about 4 feet from her before they stopped. Mr. Hardesty was standing a little ways out into the road from a small gap in the hedge fence with a 12 gauge pump shot gun in his hands. Mr. Hupp, who was on the first grader, got off and went up to Hardesty to try to reason with him, but Hardesty was not for reasoning with. Hupp then turned around and walked away from him until he got on the east side of the first grader tongue, then turned and said, "You son-of-a------, you wouldn't shoot a man in cold blood would you." At this Hardesty drawed aim and fired, hitting him in the left eye and killing him instantly. Hupp fell to the ground and Hardesty reloaded his gun. Del Herlan came up and lifted Hupp's head up to see if he was dead. It was not known what Herlan said to Hardesty. Hardesty said to Herlan, "You son-of-a------, say something, it is you I want to kill!" Herlan turned around and walked up the road. Hardesty then gave his gun to his wife and came out into the middle of the road swearing at Herlan. Hardesty and his wife drove their car into Overbrook and he gave himself up to deputy-sheriff H. Allen, who took him part way to Lyndon, meeting Sheriff Lynch, who took him the rest of the way and was locked up in the County jail. The body laid in the road from time of killing till about 3 o'clock waiting for County Coroner Dr. Brown. It was then taken to the O A Barnes home to rest until burial. The inquest was held late Tuesday afternoon at the O A Barnes home. Jury was chosen and the witnesses had been sworn and Del Herlan was the first on witness stand, questioned by County Attorney Stavely and Coroner Dr. Brown. They then drove to the scene of killing, where a diagram was drawn and investigation of scene made satisfactory. At about 7:15 the inquest was continued, jury and officials taking their places. Frezier Owens, whose home is in Missouri and who has been working for Hardesty, was second on witness stand. Tom Bachelor, third, Frank Tucker, fourth, Fred Montgomery last. The proceedings were taken down by Clerk of Court Al Justice. The gun and empty cartridges were examined. Jury was out a few minutes. Jury decision: "Henry Hupp met his death from the shot of the gun fired by Frank Hardesty." Mr. Hupp leaves a wife and 5 children to mourn his loss. The funeral will be held at Ridgeway, Thursday afternoon.
