Heirs of Story County Man Bring Action to Recover Property. Des Moines, Jan. 16.—With the filing in the district court of a petition by the heirs to the estate of John A. S. Woods, a wealthy farmer living in Union township, Story county, to set aside a certain ante-nuptial contract, an unusual situation is brought to light. The case involves the ownership of forty acres of land in Story county. According to the petition Woods died June 16, 1911. Soon after his death it was discovered by the heirs that he had signed an ante-nuptial contract with Emily Woods, which was filed in the Polk county recorder's office on Dec. 22, 1897, the day of their marriage. The contract provided that Mrs. Woods should be given the forty acres of land upon his death. The heirs declare the ante-nuptial contract is void for the reason that Emily Woods represented to her fiance that she was an unmarried woman at the time she entered into it. The petition alleges that Mrs. Woods was not a single woman, but the lawful wife of John R. Wood, alias John Wood, alias John C. Wood. She lived with John A S. Woods until his death. The heirs to the estate of Mr. Woods, the plaintiffs in action, are: Anna L. Burns, Elizabeth Burns, Samuel Woods, U. G. Woods, Lorenzo D. Woods, Arthur R. Woods, William A. Woods, and Eldridge Woods.
