Justus was a farmer in Germany.. The Heimerich's settled near Goshen, Indiana in Elkhart Co., where there was a large German-American population. Here, Justus practiced his trade as a cabinet maker. It is probable that he also farmed as he sold 26 acres for the sum of $400 to his son John on 8 Jun 1857. In 1868, Justus and a group of men from Goshen including his son John and sons-in-law Gottlob and Henry Schaubel, began making plans to move to Kansas and file claims for homesteads. In order to be eligible for a homestead claim, one must be a citizen of the United States. On 14 May 1868, Justus Heimerich became a naturalized citizen at Goshen.. After arriving in Clay County, Kansas, Justus staked his claim of 160 acres in section 19 of what would become known as Goshen Township, in honor of their previous home. He officially filed the claim 4 Aug 1868 and filed an application to secure homestead on 5 Feb 1869 at the receiver's office in Junction City. Justus built a framed house, 16' x 22' in size, 1 1/2 stories high with a shingled roof, board floors, 2 doors, 6 windows. He cultivated 30 acres of his land, fenced 20 acres in pasture, built a stable, pig pen, cattle corral, corn crib, grainery, dug and walled a well, and planted 46 fruit trees.. Justus died just five years after establishing his homestead and never saw the deed to his land. The tract of land was finally patented at the General Land Office in Washington, D.C. on 1 Aug 1874. In his last will and testament, Justus left his entire estate to his wife, Elisabeth. It was his last wish that his wife of 40 years be financially secure through the remainder of her life. But it will become apparent that through the mismanagement and dissent of their children concerning the estate, it was not to be.. A petition filed by Gottlieb Kuhnle, a son-in-law, in probate court f Clay Co., Kansas, 19 Aug 1874, reads as follows:. "That whereas it appears that the Estate of Justis Hemerick (sic) Deceased is being squandered or used in a way injurious to the Heirs, and detrimental to their interest and that there has been filed in the Probate Court purporting to be the last will and testament of said Justis Hemerick which it is believed is fraudulent and of no validity whatever. "We the undersigned do hereby petition the Probate Court in and for the County of Clay and state of Kansas that a administrator be appointed by said court to settle said Estate of Justis Hemerick. (signed) G. Kuhnle". William Lack was soon thereafter appointed administrator of the estate and an appraisal of the property was soon taken as the estate was still $300 in debt. A partial appraisal by Joseph Sander, Christian Oppenlander and William Riechers, dated 26 Aug 1874 include in entirety:. Land with house & improvements $2,000.00. Furniture 40.00. 3 Pigs 7.00. 1 Colt (1 year old) 25.00. 2 Cows and 2 Calves 50.00. 50 Fowls 6.00. 48 bushels of Rye @ 40 cents per. 19.20. 63 bushels of Oats @ 30 cents per. 18.90. 41 bushels of Spring Wheat @ 50 cents per. 20.50. Total $2,186.60. An additional account of the estate was rendered on the above appraisal being subscribed 2 Sept 1874 by C. Elisabeth Schaubel, Eliza Schaubel, and Henry Schaubel. The list reads as follows:. 2 horses, wagon and harness 232.50. 1 year old steer 10.00. 1 braking plow 16.00. 1 stiring plow 8.00. 1 double shovel plow 6.00. 1 harrow 7.00. 1 saddle 2.00. Wheelbarrow 2.00. Kraut cutter 5.00. Log chain 2.50. 2 field hoes, 2 hay forks 2.00. 1 sleigh 2.00. 1 gun 20.00. 1 carpenter's bench and tools 25.00. 50 bushels of spring wheat 45.00. 50 bushels of corn 22.50. Total $407.50. The purpose of making known the inventory of this estate is to clearly show that with the proper management, the $300 in demands against the estate could well have been covered by the personal estate and effects alone. Such was not the case. Only two items in the personal estate are recorded as having been sold: a colt, sold for $16.70 and a calf, sold for $4.00. Items such as another calf, 50 fowls, 48 bushels of Rye, a gun, and carpenter's bench and tools were listed as not having been found. Failing to settle the debts of the estate through the sale of personal effects, William Lack petitioned the court on 9 Dec 1874 to sell real estate for payment of the debts. He stated in the petition that by dividing the tract of land and selling only a portion of it would substantially reduce it's value and furthermore asked that the entire parcel be sold.. On 12 Dec 1874, Elisabeth and her son John, were served papers by William Blue ordering the sale of her land. She retaliated four days later, through her attorney C. M. Kellogg, by objecting to the Order of Sale stating that the land should be exempt from the debts of the estate as it was a homestead of farming and a home for the deceased patriarch's family where she and her 16 year old son William still occupied.
