John DeJong's unsuccessful efforts to introduce the auto delivery wagon for use in his retail grocery business in Keokuk is the basis of a $300 lawsuit which is now being tried in the district court before Judge W. S. Hamilton. the case is against Bowman-Boyer Company of this city. Examination of jurors begun this afternoon at 2 o'clock. The petition says that on January 31, 1910, the plaintiff contracted with Bowman-Boyer Company, for an automobile delivery car or wagon under the guarantee that it would give satisfaction and do the work of delivering DeJong's goods to his patrons under all conditions of weather and streets, and do the work of, and as satisfactorily as his mule team was then doing. That the plaintiff, relying upon the recommendations, paid on purchase price of the automobile the sum of $300. Continuing, the petition says that the machine was tried and tested in good faith and it failed to work: was wholly unreliable and unsatisfactory; would not climb hills; would stick in the mud; and the engine would not work. It took a great deal of time and trouble to start the engine. That defendant has made numerous efforts to make said machine do the work, but it has wholly failed, where-upon, plaintiff returned the delivery wagon and possession to defendant and demanded the return of his $300.
