Milburn had been at home he would have attended the funeral. * * * * * * * * * * * * * * * * * * * * * * Webster City Graphic Herald April 3, 1894 We learn that the remains of Lloyd Emerson were buried at Rising City, Nebraska, on the 28th. The desire of his family was to bury him at Stratford beside his father. But his friends, and he had many, at his new home would not listen to it. A delegation of the leading citizens of the place met the remains at Lincoln and accompanied them to his late home to do honor to his memory, and tender their sympathies to his bereaved mother and sister. His life amongst the people there had been exemplary, and all men his friends. * * * * * * * * * * * * * * * * * * * * * * Stratford Courier April 5, 1894 OBITUARY Levi Loyd Emerson, was born at Ridgeport, Boone County, Iowa, Mar. 3, 1873, died at Hot Springs, Arkansas March 23, 1894, aged 21 years, 20 days. At the age of nine he removed with his parents to Stratford, Iowa. He was graduated at the Iowa Agricultural College at Ames, Iowa, in 1892. For a short time after his graduation he taught school, but upon the death of his father he resigned his position as teacher and took charge of his father's real estate and loan business at Stratford, only closing it when he with his mother, came to Rising City in 1893, having made this their home until now. Since coming here he has been connected with the Commercial Bank holding the position of Assistant Cashier in that institution when death called him. He has been in poor health mostly since coming to Rising City, and had gone to Hot Springs in hope of a benefit from its baths. His only sister and widowed mother now doubly bereaved, are with us in their hour of grief, and they alone of his father's family remain to cherish fond remembrance of him they loved; as brother, son. – Rising Sun Independent. * * * * * * * * * * * * * * * * * * * * * * The Daily Freeman Tribune Webster City, Iowa April 5, 1905 BIG ESTATE SETTLED AFTER 11 YEARS Decision of Supreme Court Finally Rendered in Priscilla Emerson Estate From Stratford. CASE READS LIKE A ROMANCE Deed, Finally Found by C.A. Biernatzki of This City, Settlers Matter. Many Deaths in Case. In a decision handed down yesterday morning by the supreme court in the case of J.W. Milburn of Stratford vs. J.H. East of Rising Sun, Nebraska, final adjudication is made in the matter of the famous Priscilla Emerson estate. Everyone in and about Stratford is familiar with the various entanglements in which this large estate has been involved, the settlement of which has been pending in the courts tor eleven years. The story of the matter reads like a romance from fairy book. It is built upon family entanglement, a compromising damage suit for seduction and across the pages of the whole affair pass ever and anon a procession of the dead — for since the starting of the litigation every party to it has died, with the exception of one, and even some of the attorneys connected with it at various times have passed away. The case centers about two hundred acres of land in Webster county, which were supposed to belong to Mrs. May East, daughter of Mrs. Emerson. The finding of an unrecorded deed from Mrs. East back to her mother, however, changed the whole matter and throws this magnificent farm into the estate of Mrs. Emerson. Of the many deaths which have occurred during the pendency of the litigation, at least one is looked upon by many people as a mysterious affair and to this day there are many people in and about Stratford who even doubt that Floyd Emerson is dead. His death was announced during the pendency of a suit for seduction against him, preferred by a Stratford young woman, and it was supposed that this event would stop the case and prevent damages being secured against his estate, which was badly involved in the estate of his mother, Priscilla Emerson, and that of his sister, Mrs. May East. The Emersons years ago were wealthy and respected residents of Stratford in the southern part of the county. The family consisted of the father and mother and son, Floyd, and daughter, May. The latter married a Dr. East and the two departed soon after their marriage for Rising Sun [City], Nebraska. In 1892 the father died and the estate passed into the hands of Mrs. Emerson, her son Floyd and daughter, Mrs. East. The estate was a good sized one, estimated at from $20,000 to $40,000. The first complication that arose in the matter appeared in 1894 when a Miss Paulson of Stratford brought suit through Judge Kenyon and Captain Yeoman of Fort Dodge against Floyd Emerson for $2,000 as damages for alleged seduction. Before the case came on for trial Floyd Emerson died very suddenly and most mysteriously after an illness of but a few days. This was the first of five deaths which have occurred in connection with this famous estate, and at the time it occurred caused much comment and excitement. Many people did not believe that he was really dead, and do not even to this day. No one was able to prove that he was not, however. The case against him was not dropped though, and finally in 1896 judgment was secured for the amount asked and the costs in the case. The estate was so involved as between the mother, daughter and son, however, that proceedings had to be brought in the year 1897 to attach some of the property. In this proceeding Wesley Martin of this city was associated with Messrs. Kenyon and Yeoman of Fort Dodge. Mrs. Emerson and daughter were made defendants in this proceeding and the late John F. Duncombe of Fort Dodge appeared for them. This proceeding dragged along until 1898 and in the meantime Mrs. East died - also suddenly and mysteriously. Geo. W. Hewitt, a Council Bluffs attorney, was appointed her administrator, while J.W. Milburn of Stratford was appointed as Floyd Emerson's administrator. Of the estate the fine two hundred acre farm in Webster county had gone to Mrs. East, upon the death of her father. During this same year, Mrs. Emerson died at her home in Stratford. She, too, died suddenly, but no suspicion ever rested against the face of her demise. Mr. Milburn was also appointed as administrator of Mrs. Emerson's estate. An attempt was then made to settle the Paulson claim and Judge Hyatt of this city became interested in the case, in conjunction with Mr. Duncombe of Fort Dodge. A short time after, Mr. Hyatt also died and in the meantime many claims had accumulated against the estate, which was by this time so tangled that no payment of them could be made. The estate of Mrs. Emerson was supposed to have been exhausted and the many claims against it were almost worthless. It was at this stage of the varied proceedings, that J.W. Milburn came to this city and interested C.A. Biernatzki and Wesley Martin in the matter. This was in 1902. Mr. Biernatzki at once began an examination of the records in this and Webster county and after many weeks of work became satisfied that Mrs. Emerson had been possessed of property which the records did not show. He finally went to Fort Dodge and upon the last day that Mr. Duncombe ever appeared in his office, found an unrecorded deed there from Mrs. East, giving her fine Webster county farm back to her mother. This seemed to settle the fact that the estate of Mrs. Emerson was solvent and that the many claims against it were good. Mr. Duncombe shortly afterwards died. Mrs. Emerson had placed this deed in his hands shortly prior to her death and Mr. Duncombe, who was then in failing health, had not had time to attend to the matter. Prior to this, however, Attorney Hewitt of Council Bluffs, administrator for Mrs. East, had come to this city and in Judge Weaver's court had had Mrs. East's title confirmed n the land. For some unknown reason Mrs. Emerson permitted this to be done, although at the very time she had a deed to the land. The settlement of the whole estate then hinged upon the validity of this deed. All the parties who had been present at the time it was made were dead, with the exception of the attorney in Rising Sun [City], Nebraska, who drew the instrument. The East estate resisted it and Messrs. Biernatzki and Martin of this city brought an action to permit the administrator to dispose of this property as a part of the estate of Mrs. Emerson to satisfy the creditors. The case was brought in district court in this city before Judge J.R. Whitaker of Boone. Mr. Biernatzki and Mr. Hewitt went to Nebraska and secured the testimony of the attorney who drew the deed. It was decided in the court here that the unrecorded deed in favor of Mrs. Emerson was valid. The East heirs appealed the matter and Mr. Biernatzki, in conjunction with Mr. Martin, were compelled to take the case through this court to get a settlement of it. The rendering of the decision of this last court confirms the decision of the lower court and ends the litigation which has extended over a period of eleven of twelve years.
