The Starr genealogy says the probate records show: "Jan. 20, 1755. Whereas our late honored Father, Benjamin Starr, late of Danbury, decd, dying intestate, hath left property among us, the children and only heirs of our decd Parent, and our Mother Eunice, wid. of our decd Father, hath acquitted to us all her right of dower except &c. ... and being all of legal capacity to act for ourselves, and being mindful of a brotherly agreement among ourselves, have agreed and divided the estate as follows," etc. Signed by one son and four daughters, all the children of the deceased. Bailey records his burial in the Wooster Street Cemetery, Danbury" at the eastern end of the (then) enclosure: "Lieut. Benjamin Starr. Died Nov. 29, 1754, in his 71 year."
