The law officer said that Phillips was shot at about five p.m. yesterday at his brother's house in the vicinity of Raphlne, near Pekin on Route One, Augusta County, in the area known as "The Bottoms." This Is the story Sheriff Gilkeson told: Phillips, about 30 years old, had been missing from Charlottesville for over a year. In University Hospital there at the time, held on forgery charges, he escaped by jumping from a third story window. His family had been staying with his brother-in-law, Branchford Phillips. Lyle came to the house today, and undertook to beat up his youngest child "pretty badly." He then went up to the house, where Mrs. Branchford Phillips, who has been ill for some time, was seated on the porch. He knocked her off the porch. At this juncture, Mrs. Phillips' eleven-year-old son came around the house with a .22-cal. rifle and asked his mother whether she wanted him to shoot Lyle. When his mother said yes, he fired, first from about 20 yards distance, and missed. Lyle began throwing large stones at the child, one of which barely missing him. The youth fired again and this time hit him, the bullet entering the chest and passing through the back. Lyle began running away, and the eleven-year-old reloaded and shot again, hitting Lyle in the back. Lyle ran for a short distance, then laid down In the yard. Mrs, Phillips and the youngster not certain whether he had been hit, were afraid to go near him and he stayed on the ground for about an hour. Eventually, two neighbors came up and examined him, realized he was in bad shape, and brought him to the King's Daughters' Hospital. Authorities there pronounced his condition critical, last night, and stated that he was suffering mainly from loss of blood both before and after arriving at the hospital The Sheriff stated that he would prefer no charges until he had consulted with the Commonwealth's Attorney.
