An old grudge held by Nelson against Phipps, together with an overload of booze, seems to have been the cause for the trouble. Nelson claims that he was so drunk that he does not remember what happened. The story of Phipps, which was substantiated by a number of witnesses, was to the effect that they had been together in the afternoon, but had no trouble of any kind. While in the alley at the rear of the Miller saloon, Nelson started away, remarking that he was going to supper. He walked a short distance then turned and with an oath leaped at the negro with an open knife in hand. The two struggled a moment and Phipps finally grabbed Nelson and threw him to the ground, where he lay without making an effort to rise. As he was standing over Nelson, Phipps discovered he was badly cut and left to find a physician. Nelson was found in hiding at the Carrico residence in the northeast part of town shortly after and arrested by Marshal Hackler. The preliminary hearing, conducted by County Attorney Nichols of Madison, was held before Justice W. B. Fuerst Monday afternoon. Nelson was non-committal and on being plied with questions claimed that he remembered nothing of the trouble. A number of witnesses were examined and facts brought out substantially as stated above. Justice Fuerst bound the prisoner over in the sum of $2,500 to await trial in the district court. Nelson was unable to get bail, so he was taken to Madison by Constable Schacher and turned over to Sheriff Smith. While in jail at this place, Nelson made display of an open knife which he had evidently concealed at the time of his arrest. However, he made no attempt to use it, and was disarmed without trouble. The condition of Phipps is not serious, though he sustained some deep wounds on his head and face, the most serious being a slash which laid open the flesh from the top of his forehead to his upper lip, deeply gashing the right side of his nose. BATTLE CREEK ENTERPRISE; Battle Creek, Nebraska; Thursday, March 1910; front page NELSON TO GO FREE Pleads Guilty to Assault Will Be Paroled on Furnishing a Nominal Bond Peter Nelson, who carved up Joe Phipps, Battle Creek's only "cullud gemman," in an altercation here a few weeks ago, is to be released without further prosecution upon furnishing nominal bond for good behavior. The trial was called before Judge Welsh at Madison yesterday, but after a conference of the attorneys Nelson was allowed to plead guilty of assault with intent to wound and was recommended for leniency. Judge Welsh has decided to parole him upon bond, which Nelson will have no trouble in securing, it is said. Though a large number of witnesses were summoned from Battle Creek, no one was called to the stand. Former employers of Nelson were ready to testify that ordinarily he was a good citizen of peaceable disposition, and when all circumstances were considered, County Attorney Nichols acquiesced to a proposition to drop prosecution. PETER NELSON PASSES Had Been a Resident of Battle Creek Over Fifty Years Death came at 6:30 Monday evening to N. Peter Nelson, 81, for many years a resident of Battle Creek, at his home in the northeast part of town. Though in poor health for the past year or more, immediate cause of his death was a stroke which he suffered about a month ago. Funeral services were held Thursday afternoon at St. John's Lutheran Church with the Rev. O. C. Decker in charge. burial was in the family lot at Union cemetery. Pallbearers were G. A. Koester, E. H. Doering, Albert Stuckwisch, Fred Neuwerk, George Boyer and Chas. Hansen. Nels Peter Nelson was born April 27, 1868, in Denmark and came to the United States when 15 years old, first making his home in Illinois. In the late 90s he came to Battle Creek and for a time was employed on farms near town. Leter he moved to town and was employed in blacksmith shops. He was married July 10, 1910, to Mrs. Minnie Pilkens of Battle Creek and to this union four children were born. Surviving are his wife and two daughters, Mrs. Marie Werner, Schaller, Iowa, and Mrs. Cora Davies, Venice, Calif.; three step-daughters, May Pilkens, Omaha; Mrs. Birdie Hinzman, Rapid City, S. D., and Mrs. Betty Hinzman, Battle Creek. Preceding him in death were a son, Albert, a daughter, Mrs. Helen Murphy, and a step-daughter, Mrs. Eva Whetstone.
