The body of Richard SHELTON, 47, Indianpolis, formerly of Rochester, was found sprawled in a hallway of the York hotel when police answered a call. Lying wounded in his room was James OLIVER, 53, Indianapolis. United Press International said Oliver was taken to General hospital where his condition was described as "fair." He also was placed under arrest pending investigation. Oliver, the only witness to the shooting, said Shelton came to his room to "see how I was." He said Shelton suddenly pulled a gun and began firing as he shouted, "I'm going to kill you." Oliver said he drew his own gun and fired twice. He said Shelton "just stood there" then turned and walked out, shutting the door behind him. He slumped dead minutes later. Also arrested at the scene was William GILLEY, 44, Indianapolis. Police charged him with attempting to interfere in an arrest. The body of Shelton is being returned to the Zimmerman Brothers funeral home here. Arrangements are incomplete. Shelton was the son of the late Maurice and Zoe BRACKETT SHELTON, who once resided in Rochester. Shelton Graveside funeral services will be Saturday at 2 p.m. in the Rochester I.O.O.F. cemetery for Richard Milton SHELTON, 50, former local resident who died of gunshot wounds in an Indianapolis hotel early Thursday morning. The Rev. James RHOADS will officiate at the rites. Friends may call at the Zimmerman Brothers funeral home after 7:30 p.m. today. A preliminary charge of murder has been placed by Indianapolis police against James OLIVER, 53, in the shooting death of Shelton in the York hotel. The case against Oliver was continued until Tuesday in Municipal court, Room four. Shelton, who resided at 2025 North Meridian street, collapsed in a hall of the hotel and died after being struck in the heart with a .32 calibre slug from Oliver's gun. Oliver said he had grabbed the gun from a night table and fired twice at Shelton after the latter entered his hotel room about 2 a.m. Thursday. Oliver said that Shelton told him the visit was "to see how you are" but then he drew a gun and fired twice, announcing "I'm going to kill you." One slug struck Oliver in the left side, the other in the right forearm. He is in fair condition at Marion County General hospital. He could ascribe no motive for Shelton's actions to police. Oliver said he considered Shelton his best friend and could only surmise "that it must have been a 'rib' and somebody must have put him up to it." Born Dec. 10, 1910, in Rochester, Shelton moved to Indianapolis 42 years ago with his parents, the late Maurice and Zoe BRACKETT SHELTON. He was married Oct. 2, 1944, in Indianapolis to Alice CROZIER, who survives, along with one brother, Merriam SHELTON, Palatine, Ill., and an uncle, Lyman BRACKETT of Miami, formerly of Rochester. One brother, Brackett [SHELTON], preceded him in death in 1952. Shelton was a sales representative for the Majestic company in Indianapolis. Oliver's wife was in the hotel room at the time Shelton paid his fatal visit. She had gone into the bathroom while her husband admitted Shelton and was uninjured in the ensing gunfire.
