Milner at the Buzzard Ranch Awaiting Arrest. William Forbes Isaac Milner Yesterday afternoon Sheriff L.C. Dana received a telegram from Deputy Sheriff L.J. Tell, at Franceville, stating that one Isaac Milner had killed a man by the name of William Forbes at the Chapman Ranch about seven miles east of Crow's Roost. Beyond this the telegram gave no particulars. Sheriff Dana telegraphed Mr. Tell in response to go to the ranch and take Milner in custody. An hour or so later Coroner Davis of Manitou received a telegram from Mr. Tell conveying about the same information but without particulars. After searching the town some time in company of Undersheriff Jackson with a view to learning some fact as to the probable cause of the killing, a representative of the GAZETTE was fortunate enough to strike the Spaulding House where Mr. Reuben Winchell, an eye witness of the affair, had just registered after having rode 37 miles in about three hours. From him the following particulars of the tragedy were ascertained: Some time ago Isaac Milner and a man by the name of Chapman obtained the contract for the sinking of a well on the ranch of Mr. Pebbles near Crow's Roost, which contract was subsequently let to William Forbes and a man by the name of Higginson. They had made some progress with the work, using a windlass and other apparatus owned by Milner. On Thursday Milner notified Forbes that he has use for the windlass and would need it the next day. Yesterday morning Milner, in company with a man by the name of Hancock, drove to the locality where the well was being sunk, loaded the windlass into a wagon and returned to the cabin of the former. When they reached home they found Forbes and Higginson awaiting them. The team was left standing in the yard near the cabin and some conversation was had among the parties in regard to the removal of the windlass. Shortly afterward Forbes and Higginson jumped into the wagon and started off, but Milner grabbed the lines and saying that the team, conveyance and windlass belonged to him and they could not have it. With this Forbes knocked Milner down with the butt end of a heavy driving whip and afterwards commenced lashing him with it. At this stage of the proceedings Hancock, who had been standing by, interfered with a view to separating the two men whereupon Higginson as if by a prearranged plan attacked Hancock. Milner having in the meantime become liberated rushed into the cabin, obtained a rifle and shot Forbes through the doorway of the cabin. He was carried into the cabin where he expired only a few moments later. It was found that the ball had penetrated his left side near the nipple. Mr. Milner, who could hardly be made to believe that he had actually killed Forbes, after remaining at the cabin about an hour started off on foot over the prairie, stating in conversation with Winchell that he was so dazed by the blow from the whip that he did not realize what he was doing. Mr. Winchell speaks of Milner as an exceptionally quiet and inoffensive man, which same impression is concurred in by a number who know him in this city. While he does not think that he was exactly justified in the shooting, he says that he was exasperated to almost an unendurable extent. A warrant was issued for the arrest of Milner in Justice O'Brien's court last night and Undersheriff Jackson, in company with Charles Chapman, the owner of the ranch where the shooting occurred, left for Buzzard's Ranch, where Milner was waiting to be taken into custodyHomicide VICTIM(S): William Forbes Thursday, April 1, 1886 SUSPECT(S): Isaac Milner Saturday, April 9, 1887 - Colorado Springs Gazette - Page 4, Column 2 The jury in the Milner murder case after being out thirteen hours returned a verdict of acquittal at 7 o'clock yesterday morning. The verdict was not unexpected and Milner was the recipient of many congratulations on the part of his friends. The first ballot stood nine for acquittal to three for conviction, and a determination was not arrived at until half-past four o'clock yesterday morning.
