Cutler's History of the State of Kansas JOHN BAY, grocer, was born July 22, 1835, in La Porte County, Ind., and two years later his parents removed to Lee County, Ill., where they resided until 1854. In that year they removed to Delaware County, Iowa. In 1857 Mr. Bay struck out again towards the West, and in June located in Emporia, which place he has ever since called his home. Engaged in farming for two years. Went to Colorado in 1859, and was for a time interested mining. At the breaking out of the late war, he enlisted as a private in the Second Regiment, Colorado Cavalry. His first campaign was in New Mexico. Participated in the battles of Val Verdi, Apache Canyon, and Peralto, fighting against Texas Rangers commanded by the Rebel General Sibley. In 1863 he was in Arkansas and the Indian Territory; participated in the battles of Cabin Creek, and in several skirmishes. In 1864 was on the border fighting guerrillas, and took part in the battles of the Big Blue, the Little Blue, Westport, and Mine Creek, during the Price raid into Kansas. Previous to this he had been promoted, first to Corporal, then to Sergeant, and for four or five months had charge of a scouting party. Was taken prisoner by the guerrillas in November, 1864, and held by them as hostage against three female prisoners who were held by the United States for harboring and aiding bushwhackers. Was well treated by his captors, and was exchanged for the three women, after about a week's imprisonment. Was mustered out of service in January, 1865, at Fort Leavenworth. Returned to Emporia and engaged in commercial life. Continued in active business until 1871, when he was elected Sheriff of Lyon County. He was re-elected in 1873. Was elected Mayor of the city in 1875, and in the same year went into the grain business; continued for a year, and in 1876 the firm of Wood & Bay was formed. For three years did a retail grocery business. This firm was dissolved in 1879, and Mr. Bay has, since that time, done business alone in his own name. He has an excellent retail grocery trade. Was elected a member of the City Council in 1881, for a term of two years, and in 1882 was elected President of the Council. He married Miss Carrie Roe, of Chase County, April 4, 1866, and has had by this marriage five children, of whom Bessie, Herbert F., and an infant son unnamed are now living. ***************************************** Emporia Gazette, Friday, July 23, 1897; page 4, column2 John Bay Dead One of Emporia’s pioneers, passed away this morning at 10:30 o’clock after eight weeks of suffering which few men are called on to pass through. John Bay was a Christian clean through. He has lived among the people of this town for forty years and not one can be found who can remember of a mean act or unkind deed which could be laid at his door. He always had the good of Emporia at heart. He was for righteous in public life as for purity of the individual. John Bay was born July 22, 1835, in La Porte, Ind., and moved with his parents to Lee county, Ill., when 2 years old. In 1853, he went to Delaware county, Ia., where casted his first vote for John C. Fremont in ’56. Early in 1857 he came overland with his parents to Emporia, arriving here June 10, just forty years ago. Emporia was not much more than a mere trading post. He took a claim southeast of town, now known as McLaughlin farm, but because of a shortage of supplies, he with others, went hunting buffalo for their hides and lost his claim on account of absence. In the spring of ’59 when the Pike’s Peak boom was in its height, he left for Colorado and spent the summer mining, but returned to Emporia in the fall. He stayed here until the heat and drought blasted the country, when he went back to Colorado and remained there until the outbreak of the war, in August ’61, he enlisted in an independent company of Colorado, called Company A, under the leadership of Jas. H. Ford, who was made Colonel, of the famous Second regiment of Colorado cavalry, under who John Bay was first sergeant of Company A. He was discharged from the Army at the close of the Civil war on January 4, at Ft. Leavenworth and returned to Emporia immediately. During the early spring of 1865, he went into the grocery business with S.R. Hall in the room now occupied by S.H. Rich between Fifth and Sixth avenues. On April 4, ’66, he was married to Miss Carrie Rowe, then living in Chase county, whom he had known in Iowa. Seven children were born to them, four of whom are living. Bertha and John, ages 12 and 4 and Mrs. [Bessie] Heagler, who are living in Emporia. The other son, Herbert, is now at Danville, Ill. In 1871, John Bay was elected sheriff of Lyon county and served two terms. He was the elected mayor of Emporia in ’75, afterwards he went into partnership with Lou Wood in the building now occupied by Diefendorf’s second hand store on Commercial street. After several changes he built the brick storeroom on east Sixth avenue known as the Fluker building where he was in the grocery business. He had a racket store between Sixth and Seventh avenue then went back to the grocery business, and retired from active business a few years ago until he with his son-in-law, W.R. Heagler, brought the Fluker paper business. He joined the Church of Christ in November ‘56, at Strawberry Point, Cleveland county, IA. [Clayton County, IA]. He has always been a consistent Christian, and at the time of his death was a faithful member of the church. The funeral will be held at the Christian church on Sunday afternoon, Rev. J.W. Rev. Huston preached the sermon and remarks were made by J.T. Burton. The G.A.R. took charge of the body and held services at the cemetery.
