In 1860, William Van Wyck, aged 55, a lawyer, was living in the 42nd Regiment, Anderson County, South Carolina, post office Pendleton, with his wife, Lydia A. Van Wyck, aged 46, and children, William Van Wyck, aged 20, Zeruah Van Wyck, aged 17, Augustus Van Wyck, aged 14, Robert Van Wyck, aged 13, Lydia Van Wyck, aged 11, and Benjamin Van Wyck, aged 5. Obituary - Death of a United States Officer- We regret to understand that William Van Wyck, Assessor of Internal Revenue for the Third District, died several days ago, at his residence in Anderson. He leaves a wife, several children, and a large circle of friends to mourn his loss. Estate - South Carolina, Abbeville District: In the Name of God, Amen, I, William Van Wyck, of Anderson District, of sound mind and understanding, conscious of the uncertainty of life, make and publish this as my last will and testament hereby revoking all former wills by me made. The disposition of property I now make has been induced by the unhappy and disordered condition of the County, the fluctuating value of property, and my wish as far as it can be done, to united equality and security in the disposition I make. First, I wish as is customary that my lawful debts be paid. Second, to my son, Samuel Van Wyck, I have already given five thousand dollars this will be equal to the advancements and bequests given to my other children. Third, to my son, William Van Wyck, junior, I have now advanced two thousand dollars, I hereby give and bequest to him the sum of three thousand dollars, which with the sum advanced will make five thousand dollars. I direct this legacy to be paid after my will shall have been admitted to probate in probation, to both real and personal property, in the proper offices in the State of New York. Fourth, to my granddaughter, Zoe Banks, and Lydia Ann Banks, children of my deceased daughter, Zeruah E. Banks, I give and bequeath the sum of five thousand dollars, to be divided equally between them; and should either of them die under the age of twenty-one years and unmarried, the security of said five thousand dollars given to her, in hereby given and bequeathed to her surviving sister. I further direct that this legacy shall not be paid until two years after the probate of my will as directed in the third item of my will. Fifth, to my son, Augustus Van Wyck, I have made advances to the amount of two thousand dollars. I hereby give and bequeath to him the sum of three thousand dollars with which the sum advanced make the sum of five thousand dollars, his legacy to be paid as directly as the third item of my will. Sixth, to my son, Robert A. Van Wyck, I give and bequeath the sum of five thousand dollars to be paid him upon the probate of my will as directed in the third item of my will. Seventh, to my daughter, Lydia Ann Van Wyck, I give and bequeath the sum of five thousand dollars to be paid her as directed in the third item of my will. Eighth, to my son, Benjamin S. Van Wyck, I give and bequeath the sum of five thousand dollars, to be paid as directed in the third item of my will. I also give and devise to my said son Benjamin S. Van Wyck, and to his heirs and assigns forever a piece of land in the Town of Huntington, County Suffolk, on Long Island, adjoining lands of the late James Harrison, lying on the road leading from Huntington to Syosset and Woodbury, said parcel of land conveyed by my parents, to my brother Samuel A. Van Wyck and myself and my said brother, conveyed his security to me, these deeds of conveyance are recorded in the Clerk's Office of Suffolk County. Said parcel contains about eleven acres. Ninth, All the balance and residue of my estate (after the following bequests and devises), real and personal, mixed goods and chattels of all kinds closes in action and money whether in the State of South Carolina or the State of New York or whereever situated or found I give and bequeath to my wife, Lydia Ann Van Wyck, to her heirs and assigns forever in fee simple, suggesting that with this (?)ship, in fee, she will be enabled to execute in the most convenient way the trusts of this will this provision of course is intended to exclude my wife's rights of dower. Tenth, I request that from the property thus devised and bequeathed to my wife, Lydia Ann, she expend the sum of three thousand dollars upon the education of my son, Benjamin S. Van Wyck, this request not to be construed as imperative upon my wife, but the expenditure is to be left to her judgement and discretion; depending upon the desires of my said son, Benjamin S. Van Wyck to receive an education and such other circumstances as in my wife's opinion satisfy her of the propriety of such expenditures of which she is to be the judge. Eleventh, I constitute and and appoint my wife, Lydia Ann Van Wyck and my friend Robert P. Lee, Esq., Counselor At Law, and nephew of my old friend, John H. Lee, of New York, the testamentary guardians of my minor children. With this distinction, however, that my wife shall act during her lifetime as testamentary guardian, and after her decease the said Robert P. Lee shall act as such guardian for such of my children as may not have attained full age. Twelfth, I constitute and appoint my wife, Lydia Ann and my said friend, Robert P. Lee, executrix and executor of this my last will and testament making however this distinction that so far as the State of South Carolina is concerned, and all business connection with my estate there my wife is empowered to act in every respect as if she was the sole executrix she only need qualify in this State with respect to the State of New York and the matters and business connected with my estate there my wife, Lydia Ann and said Robert P. Lee, shall act together as the law and according to the ordinary appointment of executors.
