Russell in it: 1849-034 Loudoun Co VA (M6529) Chancery Causes: Christian Nyswanger and wife et al vs. James Russell, Infant James Russell, deceased Mary (Russell() Nyswanger Ann, Robert, James and John Russell Samuel and Sarah Neer Sarah Ann Snook, widow Amos Neer Samuel and Susannah Compton Nelson and Anne Faulkner William, Joseph, Israel, Margaret, Jane and Jonathan Russell Eliz. and William Neer David Russell, deceased To the Worshipful Justices of the County of Loudoun in Chancery Sitting: Your Orators and Oratisses, Christian Niswanger and Mary his wife, Ann Russell, Robert Russell, James Russell, John Russell, Samuel Neer and Sarah his wife, Sarah Ann Snook, Amos Neer, Samuel Compton and Susannah his wife, Nelson Faulkner and Anne his wife, William Russell, Joseph L. Russell, Israel Russell, Margaret E. Russell, Jane A. Russell and Jonathan Russell, by this their Bill of Complaint against James Russell an infant, respectfully shew unto your Worships that on or about the day of (blank month) 18 a certain James Russell died in the county of Loudoun, seized and possessed a tract of land in the north west corner of Loudoun containing to a recent survey about 161 acres, 2 Roads and 21 (peaches?), more or less. Said James Russell left a widow, your Oratess Ann Russell and had by his first wife six children, to wit: your Orators Robert Russell, James Russell and John Russell; your Oratrix Sarah married to your Orator Samuel Neer, Hannah Neer who died before her father leaving four children, to wit your Oratrix Sarah Ann Snook a widow; Amos Neer, your Oratrix Susannah married to your Orator Samuel Compton, your Oratrix Anne married to Orator Nelson Faulkner, said children of Hannah Neer, are under the will of said James Russell to receive the share of his estate to which their mother would have been entitled had she survived him. Elizabeth Neer, wife of William Neer, who died since her father without issue: Said James Russell had by his second wife, your Oratrix Ann Russell, twelve children, to wit: Your Orators William Russell, Joseph L. Russell, Israel Russell and Jonathan Russell; your Oratrix Mary married to your Orator Christian Nyswanger; your Oratrix Margaret E. Russell and Jane A. Russell, Samuel Russell, Catharine Russell and Ruth Russell who have died since their father, over age and remained without issue; Emily Russell who has died since her father under age and without issue, and David Russell, who has died since his father leaving one child, James Russell who is sought to be made the infant defendant in this suit. Your Orators and Oratrix now seek a division of the said tract of land and being (can't read word) except by the interposition of this worshipful court, they pray that said James Russell (son of David Russell) may be made a defendant to this Bill and compelled to answer the same by his guardian ad litum: that the said land may be divided among the parties entitled thereto according to their respective legal rights, and that they may have such other relief as to your Worships may (seem?) rights--to this end they pray the Courts most gracious (3 words can't make out) (signed) January (?) Miller Sols for Complaintants Respectfully Nyswanger and others vs Russell in Chancery 1848 Aug 19th Bill filed. Guardian ad Litem appointed answer of Infants by Guardian filed and decree. Dec 11 1848 former court set aside and a new decree 1849 Aug 13 Report unto said courts Nov 13 1849 Report records decree final. (page 5) The answer of James Russell, an infant under the age of twenty one years by Selden M. Gibson his guardian ad litem to a Bill of Complaint exhibited against him in the County Court of Loudoun in Chancery sitting, by Christian Nyswanger and Mary his wife and others. This respondent neither admits nor denies the allegations of said Bill having no personal knowledge of the matters therein contained, and having fully answered and denying all fraud and combination (?) he prays to be hence dismissed with his costs. (Page 7) Christian Nyswanger and others Plaintiffs vs. James Russell an infant Defendant This cause came on this day to be heard on the Bill of Complaintants and the answers of the Infant defendant by Selden M. Gibson his Guardian ad litem and was argued by counsel: Upon consideration whereof it is adjudged, ordered and decreed by the Court that the tract of land in the Bill mentioned of which James Russell deceased seized and possessed, be divided among the parties entitled thereto in the following manner to wit: One third part of the whole to be allotted to Ann Russell widow of said James Russell deceased for her nature life as her dower portion of said land, and the residue thereof to be divided and allotted as follows: one eighteenth together with two eighteenths of one eighteenth, one twenty third of two eighteenths, and one twenty first part of one eighteenth to Robert Russell; one eighteenth, together with two eighteens of one eighteenth, one twenty third of two eighteenths and, one twenty first part of eighteenth to Israel Russell; one eighteenth together with two eighteenths of one eighteenth, one twenty third of two eighteenths and one twenty first part of one eighteenth to John Russell; one eighteenth together with two eighteenths of one eighteenth, one twenty third of two eighteenths and one twenty first part of one eighteenth to Samuel Neer and Sarah his wife; one eighteenth together with two eighteenths of one eighteenth, one twenty third of 2/18 and 1/21 part of an eighteenth to Sarah Ann Snook, Amos Neer, Samuel Compton and Susannah his wife and Nelson Faulkner and Anne his wife children of Hannah Neer, deceased; 1/18, together with one eighteenth of one eighteenth, 2/23 of 2/18 and 2/21 parts of one eighteenth to William Russell; 1/18 together with 1/18 of one eighteenths, 2/23 of 2/18 and 2/21 parts of an eighteenth to Joseph L. John Grubb, Jonathan Conard, George Abell and William Grubb are hereby appointed and commissioned to execute this decree with instructions to report their proceedings to this Court in order to a final decree.
