Maxwell Fugitive After Fatal Shooting of Faye Davis A warrant charging W. E. Maxwell, 38, with first degree murder in the connection with the fatal shooting Saturday evening of Faye Davis, 48, a neighbor, at the Davis farm home, 10 miles north and 2 1/2 miles west of Emporia, was issued today from the office of county attorney Jay Sullivan. Acting coroner W. T. Crawford said he believed Davis died from a pistol wound inflicted by Maxwell, who accompanied by his son, Calvin Maxwell, 13 years old, called at the Davis home about 6:30 o'clock Saturday evening. Crawford said a bullet allegedly fired by Maxwell entered Davis' body near the left kidney and passed through his body. County Attorney Jay Sullivan said he was informed in talks with Calvin Maxwell, and relatives of Davis, that Maxwell claimed Davis owed him money in a partnership deal on livestock, dating back about two years. BOY TELLS STORY. "Papa shot Mr. Davis in the back." Sheriff Rowlands quoted Calvin Maxwell as saying. The Maxwells had gone to the Davis home in a 1935 Ford pick-up truck. The sheriff said Calvin Maxwell told him the two men engaged in an short argument and that Maxwell fired at Davis from the truck while extending the gun in front of his son who was sitting in the car beside him. OFFICERS INVESTIGATE. Sheriff Rowlands was notified of Mr. Davis' death about 8 o'clock Saturday night by Dr. Albert Beam, of Americus. It is believed Davis died about 15 minutes after he was shot. The Maxwell boy told the officers, Rowland said, that after the shooting, his father took him home and then left immediately in the pick-up truck. The Maxwell and Davis homes are about four miles apart. FUNERAL TUESDAY Funeral services for Mr. Davis will be held Tuesday afternoon. Following a short service at the home at 2 o'clock the main service will be held at the Rosean schoolhouse with Mrs. L. S. Harris, of Dunlap, in charge assisted by Rev. Charles Davis of the First Methodist church. Burial will be at the Rosean cemetery with services there by the Allen Odd Fellows. Fayette Francis Davis was born February 5, 1891, at the old Davis home in the Frost neighborhood on Allen creek. He was the youngest son of Mr. and Mrs. T. B. Davis. Mr. Davis is survived by his wife, Mrs. Mary Davis; five daughters,Mrs. James Allen, Mrs. Lucis Crumpacker, Mrs. Ray McCaw,Mrs. Rufferrer, of Allen, and Mary Evelyn Davis of the home; his mother, Mrs. Katherine Davis of Emporia, and seven brothers, W.E. Davis, of Hartford; G.M. Davis and T.B. Davis, of Allen; A.E. Davis, of Emporia; W.E. Davis, of Seattle, Washington; Harry Davis, of Emporia; a sister, Mrs. Walter Larkin, of Emporia. Three granddaughters also survive.
