KILLIAN FATALLY SHOT Funeral Services For Painters' Business Agent Set For Friday Funeral services for Joseph F. Fillian, 47, 618 Oak Street, business agent and financial secretary for the Painters' Union Local 901 who was shot and killed Wednesday night, will be held Friday at 10:30 am at the Gordon Avenue Methodist Church with Rev. M. J. Felder officiating. Interment under the direction of Hall Funeral Hall will follow in the Riverside Cemetery. Killian was killed by James W. Moore, 48, of West Monroe, around 6:30 pm in front of Simmie's Cafe, Trenton Street, West Monroe, reported authorities. He died en route to the St. Francis Hospital of four bullet wounds in his juglar vein, his right side and chest. Moore has been placed under a "tentative charge of murder." Monday morning the District Attorney's Office had filed no direct charges. Friends of Killian stated that Moore had threatened the deceased many times, and that he carried a gun continuously, "Moore was angry with Killian because he didn't get the contract for the new West Monroe High School," they said. According to witnesses, Bob "Fats" Jones, 308 Austin Street, West Monroe, and J. K. Dupuy of Shreveport, who were sitting in a car in front of Simmie's Cafe, Moore came out of the building with his wife. They stopped and appeared to be in argument, Moore pushed his wife away from him, turned and walked over to Killian, who was standing at the entrance to the Carolina Hotel. Jones and Dupuy said that Moore started scuffling with Killian, pulled his gun - and started shooting. Killian back away, and started yelling. "No, no, don't. Somebody stop him." He staggered by the car which Jone and Dupuy were in and fell to the street. Moore was taken to the West Monroe city jail after he was arrested by Deputy Sheriff D. L. Scarbrough, who was near the scene of the shooting. Officer L. G. Smith took Moore to the city jail, from where he was transferred to the Ouachta Parish jail. An inquest into the shooting will be held at 2 pm in the office of Dr. J. T. French, Ouachita Parish Coroner. A pre-inquest-inquiry by the coroner showed that Killian and Moore had previously had disagreements. Killian was vice-president of the State Painters' Council, Chairman of the Parish Rent Control Board, and President of the Central Trades and Labor Council. He was a graduate of Winnsboro High School and attended Louisiana State University. Moore, 48 year old paint contractor, of manslaughter at 12:55 this morning. Joseph F. Killian, business agent for the Monroe Painters local, was shot four times in front of a West Monroe cafe after a period of strained relations with Moore over a painting contract. Moore faces a sentence of one to 20 years in prison. He will be sentence next week. After the verdict was announced, a woman member of Moore's family embraces Defense Attorney C. E. Barham in a show of satisfaction with the verdict. The all male jury, after a two hour deliberation, returned a sentence of manslaughter, which was the minimum conviction. District Attorney Fred Fudickar, Jr., had asked a conviction of murder with the death penalty. In his summation to the jury late Wednesday, Fudickar stated that the testimony of state witnesses clearly showed that Moore was the aggressor and that there was no doubt that the crime committed was murder. The defense, led by State Senator Barham of Ruston, argued that the defendant shot Killian in self-defense. He also entered a plea of insanity and produced testimony that several members of Moore's parental family suffered mental affliction. Barham also attacked unions who exercised the privileges of denying a man work so that his family suffered. The tension between Moore and Killian had existed for some time. Testimony showed that Killian had kept Moore from receiving contracts on which he was low bidder. Moore, Killian and Moore's business attorney, Howell Heard, had a conference in the latter's office the night of January 23, 1951, the night before the fatal shooting. At this time, Killian told Moore that his reason for objecting to his receiving the contract work was that he was NOT a member of the Association of Paint Contractors. Moore had been a member but his membership had lapsed. The trial had been in progress since Monday. A jury was not completed until after noon Wednesday. Only one and a half days were necessary for the presentation of both state and defense evidence. A person who maintains good behavior at Angola, however, may be released after serving one third of his sentence. In Moore's case he can be released after serving only two years. Killian was fatally wounded January 24, 1951, in front of a West Monroe cafe. He was shot four times by Moore after than had coffee together in the cafe. District Attorney Fred Fudickar, Jr., asked for the capital punishment during Moore's trial but the defense contended that Moore was not in his right mind at the time of the shooting and that Killian had kept his from making a living for his family. Sheriff Baily Grant refused earlier last week to disclose what day Moore would be taken to Angola. Moore, who is serving a sentence of six years in the state penitentiary at Angola, will be one of five persons from the fourth judicial district to appear before the Board of Pardons when it convenes in New Orleans on July 28, 1952. Moore was sentenced to six years at the state penitentiary for the shooting of Joseph F. Killian, secretary of the painters union, in the 100 block of Trenton Street, West Monroe. When sentenced, he was told he could apply for pardon at the end of two years, or one-third of his sentence. The Board of Pardons is composed of Lt. Gov. C. E.
