Description	:	Charity Evaline or Emeline Absher Church's identity is somewhat confusing when you follow her in the records that exist. "Charity" "Evaline" & Emeline Absher may appear to be 3 separate people. After extensive research; it was determined that she is a single individual "Charity Evaline "Emeline" Absher Church. Charity E Absher's birth date (1 January 1834) as given on her death certificate is incorrect. She is not in her parents Jacob & Sarah Hall Abshers' household in 1840. "Charity" "Evaline" & Emeline Absher may appear to be 3 separate people. After extensive research; it was determined that she is a single individual "Charity Evaline "Emeline" Absher Church. Charity E Absher's birth date (1 January 1834) as given on her death certificate is incorrect. She is not in her parents Jacob & Sarah Hall Abshers' household in 1840. In 1840 the Absher household consist of 2 males under age 5 and 1 male 5 thru 9. There are no female children. Jacob & Sarah are listed as 20 thru 29. The family consist of 5 people total. "Charity Evaline" or "Evaline" as she appears in the 1850 census record (age 10) makes her birth date sometime after the 1840 census was taken. The 1850 census record does not list her as "Charity". The 1860 census records her name as "Charity" age 18 living with her mother & father "Jacob & Sarah Hall Absher". She lives in the Absher household along with her siblings. Her name does not appear as "Evaline" in this record. By 1870 her name in the record is again "Evaline" age 25. She lives with her mother & father, her siblings & nieces & nephews. Bryant Baugus age 18 lives there as well. Her name "Charity" does not appear in this record. "Charity Evaline Absher" marries "Burgess Waddell" 3 Jan 1875 in Wilkes, NC. She is age 30 in this record. Her name is recorded as "Charity E. Absher". "Burgess Waddell is quite a bit older than her. He is listed as age 65. His first wife "Catherine Cox Waddell" died in 1873. They are married by Baptist Minister "William Hall. Rev. William Hall was "Charity Evaline Abshers" uncle (her mother's brother). The place of their marriage was at "T.P. McGrady's"; it is not known at this time who T.P. McGrady is. The witnesses to their marriage were "J.C. Hall or better known as James Currel Hall". It is not known as of this writing who "B.J. Martin" & "P.P. McGrady" are. The 1880 census records "Charity" & Burgess Waddell" living in Prathers Creek, Alleghany, North Carolina. Her age is recorded to be "37" and his is recorded to be "65". "Charity" & "Burgess Waddell" were married for 9 years and have no children together. When "Burgess Waddel" dies 15 JUL 1884; Charity was provided for in his will. "Partial Transcript of Burgess Waddell's Will"; I further will and bequeath that my widow should have all my home tract of land where I now live including the dwelling house and out buildings and farm in peaceable procession during her lifetime or widowhood. But in case she marries again then she shall only have a widows dowery in said land. Dower was designed to continue that support after his death. Specifically, the widow acquired a one-third interest in whatever real estate her late husband owned. She had a right to one-third of the usage, income, and enjoyment of the land — and that right to income was protected from claims by her husband’s creditors. A wife could not inherit the land of her husband unless it was specifically devised to her in his will — in the absence of such a provision land was inherited by the husband’s bloodline. Her dower interest was not ownership of the land but rather a life estate in one-third of its use and profits. Title to the land passed directly to the husband’s heir at his death, subject to the wife’s dower. She was effectively a tenant of whichever heir inherited the land. Burgess Waddel had 2 sons that would inherit property from their father. Further partial transcript of "Burgess Waddells Will" I will and bequeath that my widow shall have choice of one horse beast and Choice of two Milk Cows and what sheep I may have at the time of my death. I further will and bequeath that my widow shall have my press cupboard and Bureau and She shall take Choice of one feather bed and bed stead and cover belonging to one bed. I further will and bequeath that my widow have my cooking vessels and kitchen furniture. I further will and bequeath that my widow have fifty dollars in money to be taken out of the proceeds of the sale of my other property. I further will and bequeath that my widow shall have one third of all my Money that I may have on hand at the time of my death, if I have any. I further will and bequeath that William Hall be appointed my widows executor on her part alone and in Case of failure otherwise on the part of the said William Hall then I appoint P R Mcgrady in his place. I further will and bequeath so long as my widow keeps a Creditable Virtuous house a law abiding good order and not lawless riotous Conduct the above provisions shall be in full force and effect in her favor. But should there arise grave and Just Cause for a such dispute against her in that Case her Executor or guardian may and shall appoint three disinterested high minded good citizens of Wilkes or Alleghany to investigate that matter and their decision shall be final and no court shall have any Jurisdiction in that case. The Will was dated 18 September 1875 in Alleghany County, NC; about 9 months after their marriage. The witness on the Will was P R Mcgrady. Around 9 months after the death of her husband "Burgess Waddell" "Charity Evaline marries a much younger man "Solomon Circero Church" age 23. "Charity Evalines" age given at her marriage was 40. They marry in Wilkes 10 March 1885 by the Justice of the Peace J.M. Hall. The witnesses of the marriage were D. Abshers & G. Abshers. "D. Abshers" could have been her brother "Dan Absher". It is unknown at this time who "G. Abshers" was. The 1900 census for "Charity Evaline" or "Charity E" (age 50) as she appears in the record is recorded to be born October 1849 which is a further discrepancy of her true birth date. Her name is recorded as "Charity E". She lives with her husband "Solomon Ciscero Church" age 38, in Wilkes, Mulberry, NC near her other family members. Their years of marriage is listed as 15. "Solomon Cicero Churchs" nephew "Robert Shumate" age 9 lives with them. By 1910 "Charity E" as recorded in the census record is listed as age 55 lives on Cane Creek Road, Mulberry, Wilkes, NC with her husband "Solomon Ciscero Church" age 48. "Robert Shumate" age 18 is in their household. The census records this is her 2nd marriage and Solomons 1st marriage; they have been married for 25 years. The 1920 census is last census "Charity" & "Solomon Ciscero Church" appear in. "Charity" age 70 & "Solomon" age 57, still live on Cane Creek Road, Mulberry, Wilkes, NC. Robert Shumate and his family live next door. Charity has no biological children. I am sure that Robert Shumate was considered by both Charity & Solomon as their child; since they have raised him from an early age and lives close to them. "Charity" dies 1 May 1921 cause of death on death certificate; injury from a fall and old age; Jacob Absher is listed as her father & Hall as her mother. Her name is recorded as "Emeline Church". The name "Emeline" could be a simple name change or a mistake on the death certificate. "Solomon Ciscero Church" dies within 2 days of "Charity" on 4 May 1921, cause of death on death certificate; lung trouble. "Charity & Solomon" were married for 36 years. They are buried by friends (undertakers on the death certificates) in the Cane Creek Church Cemetery. Her name on the marker placed for her by "Cane Creek Church" is "Charity Church".
