Description	:	Clayton Dick Herbert, called C.D., was born June 4th, 1852 in Ohio, the son of John and Lettie Briggs Herbert. His father was a farmer. By October of 1879, he was working for the Northern Pacific Rairoad as a brakeman. An accident at this time caused the loss of his leg. October 24, 1879, was Clayton's first day on the job working as a brakeman for Northern Pacific in its yard at Bismarck, Dakota Territory. At the time mentioned,he was ordered to stop with the brakes two cars which had switched upon a track in the yard. In obedience with this order, he went upon the rear car and attempted to set the brake attached to it. But the brakes were so badly broken and out of order that it could not be made to work. As soon as he discovered this, he stepped on the forward car in order to stop it. The brake on that car was a step brake and in order to work it he was obliged to place his foot on the step attached to the car below the the top, and this brought his foot and leg between the two cars. This brake was also out of order, and while attempting to set it, his foot being upon the step, the car struck another car on the track and was suddenly stopped. The draw bar and bumper of the rear car had been pulled out, and for want of them, the two cars came violently together, crushing his leg such that amputation became necessary." He sued, and the case was appealed all the way to the Supreme Court. He won a $25,000 settlement. (United States Supreme Court Reports, Volume 29, pp.755-763, at Google Books) On April 25th, 1880 in Moorehead, Minnesota, he married Barbara Elizabeth Schlingerman. They made their home in Fargo, Dakota Territory where he was listed as working in a restraunt. By 1881, they were living in Brainerd where their first son, George was born in January. He lived only 8 months. Clayton and Barbara brought his body to Mankato by train. Sadly, I cannot find where he was buried. It's said the burial was in the Old Catholic burial grounds. Their 2nd son, Frank Edward, was born in 1882 in North Dakota. Their 3rd son, Karl Clayton, was born in Mankato, MN in 1884. They appeared to be living in Mankato at this time. Around 1892, they moved to Moorehead, MN. However, their 1st daughter, Margaretha Barbara was born in 1894 in Brainerd, MN. He's listed in the 1895 Minnesota census as a bartender. Their 2nd daughter and last child was my Grandmother, Cecilia Magdelin, born 1/24/1898 in Moorehead. As you can see, they moved around a lot. By 1900, still in Moorehead, he's listed as a saloon keeper. In 1905, they moved to Brainerd and Clayton remained there the rest of his life. In August of 1908, he purchased the shuttered office of the Brainerd Lumber company in NE Brainerd, and had it re-erected on the NE corner of 6th and Main (now Washington). Early the following year he opened it for business as the "N.P. Lunch Room" - the successor to his "N.P. Lunch" counter that he operated on the SW corner. Sadly, in 1917, Barbara petitioned for and was given a divorce. She moved back to Mankato. Only two years later on 11/6/1919, Clayton died after surgery for a kidney ailment.
